About modification and amendments in the Law of the Republic of Tajikistan "About inventions"

Article 1. Bring in the Law of the Republic of Tajikistan of February 28, 2004 "About inventions" (Akhbori of Majlisi Oli of the Republic of Tajikistan, 2004, No. 2, Art. 49; 2012, No. 7, Art. 7O7; 2013, No. 3, Art. 199) following changes and amendments:

1. Add Article 4 with parts five, the sixth and seventh the following content:

"Effective period of the security document for the invention relating to medicines, pesticides and agrochemicals which use in the procedure established by the legislation of the Republic of Tajikistan requires the registration certificate of medicine of relevant organ is prolonged according to the petition of the owner of the security document by Patent authority if from the date of application for receipt of the security document for the invention before receipt of this certificate there passed more than four years.

The specified term is prolonged for time which passed from the date of application for issue of the security document for the invention about day of receipt of the registration certificate of medicine on application of product less four years, but no more than for five years.

The procedure for submission of the petition for prolongation of term of the security document for the invention and its consideration is determined by Patent authority.".

2. The sixth Article 12 to state part in the following edition:

"Rules of giving and consideration of the request for patent grant and the small patent for the invention are established by Patent authority.".

3. In Article 21 part three:

- replace the words "When Checking" with the word "Check", to replace the word "level" with the word of "level";
