About modification and amendments in the Constitution of the Republic of Moldova
The parliament adopts this constitutional law.
Art. I. – In the Constitution of the Republic of Moldova accepted on July 29, 1994 (repeated publication: The official monitor of the Republic of Moldova, 2016, No. 78, of the Art. 140) to make the following change and addition:
1. State Articles 124 and 125 in the following edition:
"Article 124. Prosecutor's office
(1) the Prosecutor's office is the independent public organization in system of judicial authority promoting justice implementation, protection of the rights, freedoms and legitimate interests of the personality, society and state by means of criminal proceedings and other productions provided by the law.
(2) Powers of prosecutor's office are performed by prosecutors.
(3) Competences, the procedure for the organization and activities of prosecutor's office are established by the law.
Article 125. Prosecutor
(1) the Attorney-General is appointed to position by the President of the Republic of Moldova on representation of the Supreme council of prosecutors for the seven-year term which cannot be resumed.
(2) the Attorney-General is dismissed by the President of the Republic of Moldova on representation of the Supreme council of prosecutors according to the law, for the objective reasons and on the basis of the transparent procedure.
(3) Appointment, transfer, increase in positions and dismissal of subordinate prosecutors are performed by the Attorney-General according to the offer of the Supreme council of prosecutors.".
2. Add with article 125/1 of the following content:
"Article 125/1. The supreme council of prosecutors
(1) the Supreme council of prosecutors is guarantor of independence and impartiality of prosecutors.
(2) the Supreme council of prosecutors consists according to the law of the prosecutors elected from structure of prosecutor's offices of all levels, and from representatives of other bodies of the public power, public organizations or civil society. Prosecutors as a part of the Supreme council of prosecutors constitute considerable part.
