About some questions of alienation of apartment houses in rural settlements

For the purpose of creating favorable conditions for effective use of apartment houses in rural settlements, and also streamlinings of state registration concerning this category of apartment houses:

1. Determine that:

1.1. purchase and sale agreements, exchanges, donations (further - agreements) the apartment houses which are in rural settlements with economic and other constructions or without them which are not registered in the territorial organizations for state registration of real estate, the rights to it and transactions with it (daleeorganization on state registration), data on which are entered in the pokhozyaystvenny book of rural executive committee till March 19, 1985 and which from this date were not objects of purchase and sale or exchange (further - apartment houses), consist in writing and are subject to registration in rural executive committee. Agreements are considered as prisoners from the date of their registration in rural executive committees. Such registration is performed free of charge.

State registration of agreements in the organizations for state registration is not required;

1.2. in case of absence at person alienating the apartment house under the agreement, the documents confirming its right to the parcel of land on which the apartment house is located data on this parcel of land in this agreement are not entered;

1.3. in case of the request of agreement parties for registration of the agreement in rural executive committee the authorized officer of this committee:

checks compliance of the data on the apartment house containing in the pokhozyaystvenny book, to the actual characteristics of this house, and also other data specified in the agreement;
