About introduction of amendments to some laws of Ukraine on reforming of management system by highways public

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following laws of Ukraine:

1. Article 20 of the Law of Ukraine "About local public administrations" (Sheets of the Verkhovna Rada of Ukraine, 1999, No. 20-21, of Art. 190; 2010, No. 10, Art. 107; 2014, No. 14, Art. 248; 2015, 28, the Art. 236) to add No. with Item 8 of the following content:

"8) exercises control of highways public of local value within administrative and territorial unit".

2. In the Law of Ukraine "About highways" (Sheets of the Verkhovna Rada of Ukraine, 2005, No. 51, Art. 556 with subsequent changes):

"State policy and the strategy of development for all types of highways in the territory of Ukraine is performed by the central executive body which provides forming and realizes state policy in the field of road economy.

Operational content of highways public and other types of highways can be performed on the basis of long-term (up to seven years) agreements (contracts) on content of highways public by the principle of providing their operational condition according to regulatory legal acts, regulations and standards.

Essential conditions of such agreement are:

subject of the agreement;

agreement price, procedure for its adjustment and application of penalties;

payment procedure of the performed works and financing sources;

size and procedure for use of the warranty amount (deduction) and reserve amount;

terms of the beginning and end of performance of works;

procedure for accomplishment and requirement to the organization of works;

procedure for reception-transmission of the performed works;

rights and obligations of the Parties;

risks insurance conditions;

procedure for ensuring works as the project documentation and material resources;

procedure for attraction of subcontractors;

procedure the customer of quality control of resources and the performed works;
