Chapter I. General provisions

Article 1. Concept about referendum

The referendum (popular vote) is form of direct participation of citizens of Turkmenistan in implementation of the government by vote.

For the solution of the major questions of the state and public life national and local referenda are held.

Article 2. Principles of holding referendum

The referendum is held on the basis of the following principles:

participation in referendum is free;

vote is voluntary and secret and is performed on

to basis general, equal and direct suffrage;

citizens of Turkmenistan participate in vote directly;

each participant of referendum has one voice.

When holding referendum publicity, participation of the public are provided, including in case of counting of votes.

Article 3. The participation right in referendum

The citizens of Turkmenistan who reached 18 years and having the right to vote according to the legislation participate in referendum.

Any direct and indirect restriction of the rights of citizens of Turkmenistan for participation in referendum is inadmissible, except the cases which are directly specified in the law.

Mentally sick citizens recognized by court incapacitated do not participate in referendum; persons containing according to the court verdict in places of detention, and also persons concerning whom according to the procedure, established by the criminal procedure legislation, the measure of restraint - detention is chosen.

Article 4. Questions of national referendum

The national referendum is held in all territory of Turkmenistan.

Can be subject of national referendum:

adoption of the new law;

change or cancellation of the current law or its separate provisions;
