Article 1

Bring in the Arbitral Procedure Code of the Russian Federation (The Russian Federation Code, 2002, No. 30, Art. 3012; 2009, No. 29, Art. 3642; 2010, No. 31, Art. 4197; 2011, No. 29, Art. 4291; 2016, No. 10, Art. 1321; No. 26, Art. 3889) following changes:

To add 1) with Article 127.1 of the following content:

"Article 127.1. Refusal in adoption of the action for declaration, statement

1. The judge refuses adoption of the action for declaration, statement if:

1) the action for declaration, the statement are not subject to consideration and permission in Arbitration Court;

2) are available taken legal effect accepted on dispute between the same persons, about the same subject and of the same bases court resolution of Arbitration Court, court of law or competent court of foreign state, except as specified, if the Arbitration Court refused recognition and carrying out of the foreign judgment, and also determination about suit abatement in connection with acceptance of refusal of the claimant of the claim or approval of the voluntary settlement of the parties or determination about refusal in adoption of the action for declaration, statement;

3) there is become obligatory for the parties and accepted on dispute between the same parties, about the same subject and of the same bases decision of reference tribunal, except as specified, if the Arbitration Court refused issue of writ of execution on forced execution of the decision of reference tribunal or if the Arbitration Court cancelled the specified decision.
