About modification of some legal acts of Ukraine
The Verkhovna Rada of Ukraine decides:
I. Make changes to the following legal acts of Ukraine:
1. In the Labor code of Ukraine (The sheet of the Verkhovna Rada of USSR, 1971, Appendix to No. 50, the Art. 375):
1) in Article 95:
the first and second to state parts in the following edition:
"The minimum wage is the minimum wage established by the law for the monthly (hour) regulation of work executed by the worker.
The minimum wage is established at the same time in monthly and hourly sizes";
the fifth to add part with the words "use work of hired employees, with any wages system";
Article 96 to state 2) in the following edition:
"Article 96. Wages systems
Wages systems is tariff and other systems which are created on estimates of complexity of the performed works and qualification of workers.
The tariff wage system includes: scales of charges, tariff charges, schemes of official pay rates and professional standards (qualification characteristics).
The tariff wage system is used in case of job sharing depending on their complexity, and workers - depending on qualification and according to categories of scale of charges. It is basis for forming and differentiation of the sizes of the salary.
The scale of charges (the scheme of official pay rates) is created on the basis of the tariff charge of the working first category and qualification (interofficial) ratios of the sizes of the tariff charges (official pay rates).
The scheme of official pay rates (tariff charges) of employees of the organizations, institutions and the organizations financed from the budget is created on basis:
the minimum official pay rate (tariff charge) established by the Cabinet of Ministers of Ukraine;
interofficial (qualification) ratios of the sizes of official pay rates (tariff charges) and tariff coefficients.
The minimum official pay rate (tariff charge) is established in the amount of at least subsistence minimum, the calendar year established for able-bodied persons for January 1.
Reference of the performed works to certain job grades and assignment of qualification categories by the worker is made by the owner or the body authorized by the owner according to professional standards (qualification characteristics) in coordination with elected body of primary trade-union organization (the trade-union representative).
Requirements to qualification and special knowledge of workers, their tasks, obligation and specialization are determined by professional standards or qualification characteristics of professions of workers.
The procedure for development and approval of professional standards is determined by the Cabinet of Ministers of Ukraine.
The procedure for development and approval of qualification characteristics is determined by the central executive body providing forming of state policy in the field of work and social policy.
The collective agreement and if the agreement was not signed - the order (order) of the owner or authorized by it body published after approval of elected body of primary trade-union organization (the trade-union representative), and in case of absence of primary trade-union organization - with freely elected and authorized representatives (representative) of workers, other wages systems can be installed";
The paragraph of the sixth part two of Article 265 to replace 3) with three new paragraphs of the following content:
"Non-admission to conducting check concerning compliance with law about work, creation of obstacles in its carrying out - in triple size of the minimum wage established by the law at the time of violation identification;
making of the actions provided by the paragraph the sixth this Item when conducting check concerning identification of the violations specified in the paragraph the second to this part - in hundredfold size of the minimum wage established by the law at the time of violation identification;
violation of other requirements of the labor law, except provided by paragraphs the second - the seventh this part, - in the amount of minimum wage".
2. In the Code of Ukraine about administrative offenses (The sheet of the Supreme Council of USSR, 1984, Appendix to No. 51, the Art. 1122):
in the paragraph the second shall be replaced with words notes to Article 172-6 of the word of "minimum wages" "subsistence minimums for able-bodied persons";
in Item 2 parts one of Article 255 the word and figures "103-1" shall be replaced with words also in figures "parts one - the fourth articles 41, of article 103-1".
3. In the paragraph the second notes to article 366-1 of the Criminal code of Ukraine (2001, Art. No. 25-26, 131) words of "minimum wages" shall be replaced with words sheets of the Verkhovna Rada of Ukraine "subsistence minimums for able-bodied persons".
4. In part seven of Article 135 of the Land code of Ukraine (2002, Art. No. 3-4, 27) words of "minimum wage" shall be replaced with words sheets of the Verkhovna Rada of Ukraine "subsistence minimum for able-bodied persons".
5. In part five of Article 182 of the Criminal Procedure Code of Ukraine (2013, Art. No. No. 9-13, 88) words of "minimum wage" shall be replaced with words sheets of the Verkhovna Rada of Ukraine "subsistence minimum for able-bodied persons".
6. Part third of article 22 of the Law of Ukraine "About bases of social security of disabled people in Ukraine" (Sheets of the Supreme Council of USSR, 1991, No. 21, Art. 252; 2007, 33, the Art. 441) to state Sheets of the Verkhovna Rada of Ukraine to No. in the following edition:
"During training in the specified categories of citizens the academic grant (in case of appointment) and pension (the government public assistance to disabled people since the childhood and to handicapped children) are paid in complete size".
7. In article 85 of the Law of Ukraine "About provision of pensions" (Sheets of the Verkhovna Rada of Ukraine, 1992, No. 3, Art. 10; 2012, No. 12-13, of Art. 82; 2015, No. 22, Art. 145; 2016, No. 5, Art. 50):
And figure "during the period from January 1, 2016 to December 31, 2016" shall be replaced with words 1) in part three of the word "till December 31, 2017";
2) in part four:
in paragraph one of the word and figures "during the period from January 1, 2016 to December 31, 2016" shall be replaced with words "till December 31, 2017";
in the paragraph the second words "work at positions and at the conditions provided by the laws of Ukraine "About public service" shall be replaced with words and in figures "who hold the positions of public service determined by the Law of Ukraine of December 10, 2015 No. 889-VIII "About public service" and also work at positions and at the conditions provided by the laws of Ukraine";
To replace 3) in part six of figure "2017" with figures "2018".
8. In the Law of Ukraine "About the status and social protection of the citizens who were injured owing to the Chernobyl catastrophic crash" (Sheets of the Verkhovna Rada of Ukraine, 1992, No. 13, Art. 178; 1996, No. 35, Art. 162; 2006, No. 49, Art. 485; 2008, No. No. 5-8, of Art. 78; 2012, No. 12-13, of Art. 82; 2015, No. 22, Art. 145; 2016, No. 5, Art. 50):
26 parts one of Article 20, the paragraph the second Item 6 parts one of Article 22, item 4 of part three of Article 30 of the word of "the raised grant" shall be replaced with words 1) in Item "social grant";
2) in Article 58:
in part one:
in paragraph one of the word and figures "during the period from January 1, 2016 to December 31, 2016" shall be replaced with words "till December 31, 2017";
in the paragraph the second words "work at positions and on the conditions provided by the laws of Ukraine "About public service" shall be replaced with words "who hold the positions of public service determined by the Law of Ukraine of December 10, 2015 No. 889-VIII "About public service" and also work at positions and at the conditions provided by the laws of Ukraine";
