About modification and amendments in article 21 of the Law on the Constitutional court No. 317-XIII of December 13, 1994

Art. I. – In article 21 of the Law on the Constitutional court No. 317-XIII of December 13, 1994 (Official monitor of the Republic of Moldova, 1995, No. 8, of the Art. 86), with subsequent changes and amendments, to make the following changes and additions:

in parts (2) and (the words "and provision of pensions" to exclude 3);

add Article with parts (4-1)–(4-3) in the following edition:

"(4-1) Judge of the Constitutional court who reached age of 50 years and having working life at least 20 calendar years including in judgeship of the Constitutional court within one complete term of office, have pension entitlement for long service in the amount of 55 percent of the average salary with addition of 3 percent for each complete year of work over 20 years, but in total no more than 80 percent of its average salary, taking into account wages indexation.

(The long-service pension is paid to 4-2) Effective judge in full.

(4-3) After award of pension the judge has the right to find a job and receive pension and the salary in full.".

Art. II. – To the judges of the Constitutional court who are in resignation, on the date of entry into force of this law reached retirement age, but which have no special insurance years of service of 12 years and 6 months in judgeship and which have no pension entitlement of the judge pension is subject to recalculation according to article I provisions.
