About introduction of amendments to the Town-planning and construction code of the Azerbaijan Republic
Being guided by Item 20 of part I of article 94 of the Constitution of the Azerbaijan Republic, in connection with application of the Law of the Azerbaijan Republic "About protection of green plantings" of May 2, 2014 the Majlis of the Azerbaijan Republic decides Millie's No. 957-IVQ:
In the Town-planning and construction code of the Azerbaijan Republic (Collection of the legislation of the Azerbaijan Republic, 2012, No. 9, Article 838; 2014, No. 7, Articles 766, 787, No. 10, Article 1165; 2015, No. 5, Article 503) to make the following changes:
1. In Article 23.2.12 to the word "parks" to add with the words "according to regulation of providing the settlement with green plantings".
2. At the end of Article 57.2.7 to replace point with semicolon and to add with Article 57.2.8 of the following content:
"57.2.8. in the project documentation of construction shall be completely and data concerning condition of green plantings are precisely reflected in the territory during the preproject and postproject periods, laying of green plantings shall meet standards of providing this settlement with green plantings.".
3. State Article 68 in the following edition:
"68.1. Construction works shall be carried out according to regulations of environmental protection, ecological safety and sanitary and hygienic regulations, and also regulations of providing settlements with green plantings.
68.2. Regulations of providing settlements with green plantings are established by relevant organ of the executive authority.".
4. State Article 85.4 in the following edition:
"85.4. Measures for protection of trees, bushes and other green plantings in the territory of construction shall be provided in the construction license. Data on quantity, specific structure and cost of recovery of the green plantings withdrawn as a result of execution of the construction project are made to the ecological section of the construction project.".
