The government of the Republic of Kazakhstan and the Cabinet of Ministers of Ukraine which further are referred to as the Party, and separately - the Kazakhstan side and the Ukrainian side respectively,

being guided by the Agreement between the Government of the Republic of Kazakhstan and the Government of Ukraine on cooperative principles in oil and gas industries of July 9, 1996;

recognizing that petrotransport complexes of the Parties are essential factor of development of economy of both states;

in view of interest of the Parties in development and deepening of further mutually beneficial cooperation in the field of oil transportation, including transit and deliveries to consumers,

agreed as follows:

Article 1

This Agreement determines procedure, conditions, the general principles of delivery and transit of the Kazakhstan oil across the territory of Ukraine.

Article 2

The parties on the basis of mutual advantage, mutual assistance and non-admission of the actions causing economic loss each other will develop in every possible way cooperation in the petrotransport sphere.

The parties will create, within the available capacities of petrotransport systems, condition for implementation of safe, effective, free, and also stable oil transportation on the territories of the states.

The Ukrainian side, within the available capacities of the operating petrotransport system, will provide free supply and transit of the Kazakhstan oil.

The parties not make unilaterally decisions which lead to deterioration in conditions of oil transportation and its termination within this Agreement.

Article 3

The parties are recognized that the property right to the oil transported with use of any of petrotransport systems of the Parties remains for the corresponding consignors, according to contracts between authorized organizations of the Parties.
