Chapter 1. Procedure for forming and the direction by bank of the message on opening or about account termination, about change of customer account details

1.1. The electronic message created according to Item 1.1 of the Provision of the Bank of Russia of September 7, 2007 No. 311-P "About procedure for the message bank in electronic form to tax authority about opening or about account termination, contribution (deposit) on change of account details, contribution (deposit)", No. registered by the Ministry of Justice of the Russian Federation on October 8, 2007 10265, on July 7, 2010 No. 17755, on December 14, 2010 No. 19176, on May 20, 2014 No. 32352 ("the Bulletin of the Bank of Russia" of October 17, 2007 No. 58, of July 21, 2010 No. 42, of December 17, 2010 No. 69, of May 28, 2014 No. 46) (further - the Provision of the Bank of Russia No. 311-P), at the same time is the message sent to territorial authority of the insurer.

Each created electronic message which is subject to inclusion in the transport file of bank of the first type provided by the paragraph the second Item 1.4 of the Provision of the Bank of Russia No. 311-P (further - the transport file of bank of the first type), after supply with its code of authentication (further - KA) bank according to Item 1.1 of the Provision of the Bank of Russia No. 311-P is ciphered by bank at the same time on two receivers with use of open keys of enciphering of each of them applied to exchange of information with authorized division of the insurer and authorized tax authority.

1.2. Delivery of the electronic message of the bank created according to Item 1.1 of this provision is performed according to the procedure, established by the Provision of the Bank of Russia No. 311-P, taking into account the features established by this Provision through territorial office of the Bank of Russia in which subordinated territory the bank is located (further - territorial office), and through Department of information technologies of the Bank of Russia (further - DIT) in authorized division of the insurer for subsequent delivery of the electronic message in territorial authority of the insurer.

The territorial office within control of the transport file of bank of the first type according to Chapter 2 of the Provision of the Bank of Russia No. 311-P also exercises control of zashifrovaniye by bank of each of included in the specified file of electronic messages at the same time on two receivers with use of open keys of enciphering of each of them applied to exchange of information with authorized division of the insurer and authorized tax authority.

By results of the control procedures established by Chapter 2 of the Provision of the Bank of Russia No. 311-P and this Item, the territorial office creates and sends to bank the notification on adoption (rejection) of the transport file of bank of the first type by territorial office according to Items 2.2 - 2.4 Provisions of the Bank of Russia No. 311-P.

1.3. Sends summary archive files of territorial offices of the first DIT type to authorized division of the insurer with the simultaneous direction of the specified archive files in authorized tax authority according to the Provision of the Bank of Russia No. 311-P.

The summary archive files of territorial offices of the second type accepted by DIT according to the Provision of the Bank of Russia No. 311-P do not go to authorized division of the insurer.

1.4. DIT provides the direction of the summary archive files including transport files of authorized tax authority of the first type, received according to the Provision of the Bank of Russia No. 311-P and containing receipts on adoption (rejection) by authorized tax authority of the electronic message, and also the notice on mistakes in authorized division of the insurer in day of their obtaining from authorized tax authority. Receipts on adoption (rejection) by authorized tax authority of the electronic message, and also notices on mistakes containing in transport files of authorized tax authority of the first type undergo the procedure of authentication in authorized division of the insurer.

The summary archive files including the transport files of authorized tax authority of the second type accepted by DIT according to the Provision of the Bank of Russia No. 311-P in authorized division of the insurer do not go.

1.5. By transfer of electronic messages, transport files from authorized division of the insurer in banks territorial offices and DIT provide invariance of all data containing in them and also protection against unauthorized access to them of the third parties.

Transfer of electronic messages, transport files is performed using the means of cryptographic information security accepted to use in the Bank of Russia under approval of the insurer, according to the procedure, established by the Provision of the Bank of Russia No. 311-P.

Chapter 2. Work of banks with the receipts and notices arriving from authorized division of the insurer

2.1. The bank receives the receipt containing confirmation about receipt of the electronic message, created by authorized division of the insurer in electronic form and supplied with KA of the specified division (further - the receipt on receipt of the electronic message), after obtaining by authorized division of the insurer of the electronic message of bank and the receipt on acceptance by authorized tax authority of the specified electronic message.

The electronic message of bank concerning which the authorized division of the insurer receives the receipt on its rejection by authorized tax authority is excluded from further processing. In this case the receipt on receipt of this electronic message by authorized division of the insurer is not created and to bank does not go.

2.2. In cases of detection of discrepancy of the data specified in earlier received electronic message, to the accounting data which are available for the insurer, by authorized division of the insurer the notice on need of adjustment of earlier received electronic message supplied respectively A KA of the specified division and sent in electronic form to DIT for its subsequent delivery in bank through territorial office can be created (further - the notice on adjustment).

2.3. The receipts on receipt of the electronic message addressed to the same bank, and also notices on adjustment arrive in bank from territorial office as a part of the transport files of authorized division of the insurer created by means of the program of the archiver.

2.4. In case of non receipt by bank of the receipt on the receipt of the electronic message after ten working days after day of its direction according to the procedure established by the Provision of the Bank of Russia No. 311-P on condition of receipt by this bank of the receipt on adoption of this electronic message by authorized tax authority the bank can send the written request in any form to authorized division of the insurer for clarification of the reasons of nondelivery of the corresponding receipt on receipt of the electronic message with appendix to request provided by the Provision of the Bank of Russia No. 311-P of the copy of the notification on acceptance by territorial office of the transport file of the bank containing the corresponding electronic message, and copies of the receipt on adoption of the electronic message by authorized tax authority.

2.5. In case of receipt of the notice on adjustment the bank creates the electronic message taking into account corrected data and sends it respectively to authorized division of the insurer according to the procedure, established by this Provision, no later than five working days following behind day of receipt by bank of the notice on adjustment.

The specified term is prolonged up to fifteen working days if forming and the direction by bank of the electronic message is connected with obtaining from the client of the additional documents and data necessary for correction of the relevant data.

If the bank, proceeding from the available data and documents submitted by the client, has no bases for adjustment of the insurer of the electronic message who is earlier received by authorized division on which the bank receives the notice on adjustment, information on it is carried by bank to territorial authority of the insurer in any written form with adherence to deadline established by the paragraph the second this Item.

2.6. From the electronic messages supplied with KA, and also ciphered with use of open key of enciphering of the receiver applied to exchange of information with authorized division of the insurer, the this provision created during the working day according to Item 2.5, the bank creates according to the procedure, established by the Provision of the Bank of Russia No. 311-P, the transport files intended for sending to authorized division of the insurer (further - transport files of bank of the fourth type).

Transport files of bank of the fourth type are supplied with KA of bank and go to the same working day in which they were created, till 16 hours 00 minutes local time on communication channels or on the magnetic carrier to territorial office for subsequent delivery of the electronic messages included in them through DIT in authorized division of the insurer.

The territorial office provides acceptance directed on communication channels or on the magnetic carrier of transport files of bank of the fourth type on the working days till 16 hours 00 minutes local time.

2.7. The transport files of banks of the fourth type accepted during the working day by territorial office and which underwent testing according to Chapter 2 of the Provision of the Bank of Russia No. 311-P are unpacked by territorial office by means of the program of the archiver.

From all electronic messages received as a result of unpacking of transport files of bank of the fourth type, the territorial office creates and sends to DIT according to the procedure, established by the Provision of the Bank of Russia No. 311-P, taking into account the features established by this Provision, the summary archive file of the fourth type.

DIT sends the summary archive files of the fourth type received from territorial office to authorized division of the insurer no later than 18 hours 00 minutes Moscow time of the working day following behind day of their obtaining from territorial office.

2.8. DIT provides the direction of the summary archive files including transport files of authorized division of the insurer in day of their obtaining from the specified division in territorial office for subsequent delivery in bank with use of the communication channels applied in the Bank of Russia to transfer of statistical information.

2.9. The territorial office from DIT of summary archive files of authorized division of the insurer performs on receipt their razarkhivation by means of the program of the archiver. The transport files of authorized division of the insurer received as a result of razarkhivation go territorial office to bank on communication channels or on the magnetic carrier no later than 18 hours 00 minutes local time of the working day following behind day of their obtaining from DIT.

The bank provides acceptance of transport files of the representative of division of the insurer from territorial office for communication channels or on the magnetic carrier and carries out the procedure of authentication of the receipts on receipt of the electronic message, and also notices on adjustment containing in them.

2.10. In case of negative result of the procedure of authentication of the receipt on receipt of the electronic message and (or) the notice on adjustment the bank informs on it the official of authorized division of the insurer specified in office part of the receipt on receipt of the electronic message and (or) the notice on adjustment. In this case the authorized division of the insurer repeatedly sends to bank the specified documents according to the procedure, established by this Provision and the Provision of the Bank of Russia No. 311-P.

2.11. In the bank rules determined by bank the procedure for bringing to the bank branch which is not given the right of the independent direction of the electronic messages received by bank (the bank branch having bank identification code) of receipts on receipt of the electronic message, and also notices on adjustment shall be established.

Chapter 3. Final provisions

3.1. This Provision becomes effective after 10 days after day of its official publication.

3.2. The Bank of Russia in time no later than 30 days after day of entry into force of this provision provides development and placement on the official site of the Bank of Russia on the Internet approved with the insurer:

formats and structure of the receipt on receipt of the electronic message, the notice on adjustment, and also the reference book of codes of the mistakes included in the notice on adjustment;

structures of names of transport files of bank of the fourth type, summary archive files of territorial office of the fourth type, transport files of authorized division of the insurer, summary archive files of authorized division of the insurer;

information on admissible amounts of transport files of bank of the fourth type, summary archive files of territorial office of the fourth type, transport files of authorized division of the insurer, summary archive files of authorized division of the insurer.

3.3. The changes approved with the insurer in formats, structure and names of the files specified in Item 3.2 of this provision and also in information on admissible amounts of the transport and archive files specified in Item 3.2 of this provision are posted on the official site of the Bank of Russia on the Internet and applied after 30 days after day of their placement if information on later terms of their application is not posted on the official site of the Bank of Russia on the Internet.
