Chapter 1. General provisions

Article 1. Subject of regulation of the Law

This Law governs the legal and economic relations on the organization and implementation of motor transportation activities in the Republic of Armenia, the relations connected with operation of vehicles, transportation of passengers, baggage and loads, services in servicing and safety of transportations by the legal entities and physical persons participating in this process and also their rights and obligation.

Article 2. Law coverage

1. Operation of this Law extends to all subjects organizing or performing motor transportation activities.

2. Operation of this Law does not extend to the motor transportation activities performed for the purpose of military transportations and rescue, prompt actions, private and office use and also in case of emergency situations and other cases established by the law.

3. The relations connected with charity in the field of road transport are regulated by the Law of the Republic "About charity".

Article 3. Legislation on road transport

The legislation on road transport consists of the Civil code of the Republic of Armenia, the Law of the Republic of Armenia "About transport", this Law and other legal acts.

If international treaties of the Republic of Armenia establish other regulations, than those which are provided by this Law then are applied regulations of international treaties.

Article 4. Basic concepts of the Law

In this Law the following basic concepts are used:

road transport - set of vehicles, means of communication (highways) and technical structures and structures (objects of road transport);

the sphere of road transport - the sphere of transport system which covers vehicles, technologically interconnected system of other objects of road transport connected with handling works, provision of services on transport servicing and delivery, and also with operation and servicing of vehicles and highways;

motor transportation activities - the activities connected with technical means, process of the organization and implementation of transportations by road transport and also with provision of services on autostation or dispatching servicing, the transportations by road transport provided for implementation;

the participant of motor transportation activities - the legal entity or physical person providing services in autostation or dispatching servicing transporting road transport connected with process of the organization of transportations;

object of road transport - the building or structure ensuring safety, technical readiness of railway vehicles of road transport and the organization of process of transportations, assembly points, places of collection of automotive vehicles, stations and Items of maintenance of railway vehicles of road transport, the auto repair plants, bus stations, bus stations, control offices, highways, bridges, tunnels, other auxiliary buildings and structures on their servicing and repair;

road transport public - the vehicle, the car or railway vehicles of road transport on which the carrier shall perform paid transportation of passengers, baggage and loads upon the demand of any citizen or the legal entity and under the agreement on transportation;

the vehicle - the wheel vehicle for transportation across highways of passengers and loads and also equipped for accomplishment of not transport works;

railway vehicles of road transport - community of the wheel self-propelled or towed by means of the car vehicles for transportation of the passengers, baggage and loads across highways and also provided for accomplishment of not transport works and equipped for this purpose;

bus station - complex of the structures providing servicing of passengers in settlements which includes the waiting room with a capacity more than 75 people, ticket offices, platforms for landing and disembarkation of passengers, the platform for the parking of buses, Items of survey and cleaning of buses;

bus station - complex of the structures providing servicing of passengers in settlements which includes the waiting room with a capacity up to 75 people, ticket offices, platforms for landing and disembarkation of passengers, the platform for the parking of buses; the bus station organizing and servicing transportation of goods is considered freight bus station;

control office - the structure provided for regulation by the dispatcher or other technical tool of operation of the vehicles performing regular transportations according to schedules of movements where services in servicing are not provided;

the bus - the car which number of places for sitting, except for driver's seat, exceeds eight; the bus having 9-17 places for sitting without driver's seat is considered the minibus;

the automobile passenger car - the car which number of places for sitting, except for driver's seat, does not exceed eight;

the passenger car taxi - the automobile passenger car by means of which according to the legislation of the Republic of Armenia provision of services on servicing is performed;

intra municipal transportation - the transportation performed within the administrative territory of municipality;

suburban transportation - transportation on distance to 50 km inclusive from starting point to terminal point of transportations which starting or terminal point is behind borders of the administrative territory of the city (settlement);

long-distance transportation - the transportation performed on distance more than 50 km from starting point to terminal point of transportations;

vnutrimarzovy transportation - the transportation performed in borders of the administrative territory of the marz;

mezhmarzovy transportation - the transportation through the administrative territories of other marzer performed between marzer en route or without transit;

interstate transportation - the transportation through the territories of other states performed between the states en route or without transit;

regular transportation - the transportation performed on the established way and the approved schedule of movement, on the offered transportation payment with the approved stops for landing and disembarkation of passengers, and also in the mode of the share taxi;

irregular transportations – the transportations performed by individual orders of the organizations or citizens which conditions are determined in each case by mutual consent of the customer and carrier;

service of passenger traffic on electronic platform - provision of services on acceptance and transfer of orders for transportation of passengers by electronic method, including on the Internet, with use of information technologies;

cabotage transportation - the transportations performed by carrier of other country between two Items located in the territory of the Republic of Armenia with use of the vehicle registered in other country;

route - the transit established for movement of the vehicle from starting point of transportation to final;

the mountain route - route which visibility of road surface is less than 60 meters, and from the opposite vehicle - 120 meters in horizontal section has radius less than 1500 meters on cambers and less than 1200 meters on concavity, includes transitions on the massif and the difficult, sharply cut up or insufficiently steady rocks accompanied with gorges - one or several - on average with horizontal inclination from 40 to 60 percent and more, 6 windings in length from 2 to 1 km or with radius less than 100 meters at distance to 1 km respectively, with two or more road pieces;

the shuttle bus - the bus performing regular transportations with landing and disembarkation of passengers established by this route;

the share taxi - the minibus on which regular transportation along the established route with landing of passengers in the number of places for sitting only at the established stops and disembarkation upon the demand of passengers in any Item of route is performed;

operator – the organization or the individual entrepreneur or the organization with 100 percent communal participation rendering services in implementation of regular transportations of passengers by road transport public in the territory of the Republic of Armenia;

the scheme of route - the document of servicing of route which contains data on route stops (in interstate transportations - border crossing points), distances between stops;
