"Article 13.11. Violation of the law of the Russian Federation in the field of personal data

1. Processing of personal data in cases, not stipulated by the legislation the Russian Federation in the field of personal data, or the processing of personal data incompatible with the purposes of collection of the personal data, except as specified, provided by part 2 of this Article if these actions do not contain penal act, -

attracts the prevention or imposing of administrative penalty on citizens at the rate from one thousand to three thousand rubles; on officials - from five thousand to ten thousand rubles; on legal entities - from thirty thousand to fifty thousand rubles.

2. Processing of personal data without consent in writing the subject of personal data on processing of its personal data in cases when such consent be received in accordance with the legislation of the Russian Federation in the field of personal data if these actions do not contain penal act, or processing of personal data with violation established by the legislation of the Russian Federation in the field of personal data of the requirements to the scope of information included in consent in writing in the subject of personal data on processing of its personal data -

attracts imposing of administrative penalty on citizens at the rate from three thousand to five thousand rubles; on officials - from ten thousand to twenty thousand rubles; on legal entities - from fifteen thousand to seventy five thousand rubles.

Failure to carry out by the operator of the stipulated by the legislation Russian Federation in the field of personal data of obligation on the publication or providing otherwise unrestricted document access determining policy of operator for processing of personal data, or data on implementable requirements to personal data protection -

attracts the prevention or imposing of administrative penalty on citizens in the amount of seven hundred to one thousand five hundred rubles; on officials - from three thousand to six thousand rubles; on individual entrepreneurs - from five thousand to ten thousand rubles; on legal entities - from fifteen thousand to thirty thousand rubles.

4. Failure to carry out by the operator of the stipulated by the legislation Russian Federation in the field of personal data of obligation on provision to the subject of personal data of information concerning processing of its personal data -

attracts the prevention or imposing of administrative penalty on citizens at the rate from one thousand to two thousand rubles; on officials - from four thousand to six thousand rubles; on individual entrepreneurs - from ten thousand to fifteen thousand rubles; on legal entities - from twenty thousand to forty thousand rubles.

5. Failure to carry out by the operator in the terms established by the legislation of the Russian Federation in the field of personal data, the requirement of the subject of personal data or his representative or authorized body for protection of the rights of subjects of personal data about refining of personal data, their blocking or destruction if personal data are incomplete, obsolete, inexact, illegally received or are not necessary for stated purpose of processing, -

attracts the prevention or imposing of administrative penalty on citizens at the rate from one thousand to two thousand rubles; on officials - from four thousand to ten thousand rubles; on individual entrepreneurs - from ten thousand to twenty thousand rubles; on legal entities - from twenty five thousand to forty five thousand rubles.

6. Failure to carry out by the operator when processing personal data without use of the automation equipment of obligation on observance of the conditions providing in accordance with the legislation of the Russian Federation in the field of personal data safety of personal data in case of storage of material carriers of personal data and excluding unauthorized access to them if it entailed illegal or accidental access to personal data, their destruction, change, blocking, copying, provision, distribution or other wrongful acts concerning personal data, in the absence of signs of penal act -

attracts imposing of administrative penalty on citizens in the amount of seven hundred to two thousand rubles; on officials - from four thousand to ten thousand rubles; on individual entrepreneurs - from ten thousand to twenty thousand rubles; on legal entities - from twenty five thousand to fifty thousand rubles.

Failure to carry out by the operator, being the state or municipal body, the stipulated by the legislation Russian Federation in the field of personal data of obligation on depersonalization of personal data or non-compliance with the established requirements or methods for depersonalization of personal data -

attracts the prevention or imposing of administrative penalty on officials at the rate from three thousand to six thousand rubles.";
