About modification of some legal acts of Ukraine concerning enhancement of town-planning activities

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Code of Ukraine about administrative offenses (The sheet of the Supreme Council of USSR, 1984, Appendix to No. 51, the Art. 1122):

Article 96 to state 1) in the following edition:

"Article 96. VIOLATION of REQUIREMENTS of the LEGISLATION, CONSTRUCTION REGULATIONS, STANDARDS AND RULES IN CASE OF the CONSTRUCTION

Violation of requirements of the legislation, construction regulations, standards and rules and the approved project decisions in case of new construction, reconstruction, restoration, capital repairs of objects or constructions

attract imposing of penalty on citizens from fifty to hundred free minima income of citizens and on officials - from two hundred to three hundred free minima income of citizens.

attract imposing of penalty from two hundred to three hundred free minima income of citizens.

Accomplishment of construction works without notice about the beginning of accomplishment of the specified works on objects which construction is performed based on the construction passport, and also submission of doubtful data in such message

attract imposing of penalty from two hundred fifty to three hundred fifty free minima income of citizens.

Accomplishment of construction works without notice about the beginning of accomplishment of the specified works, and also submission of doubtful data in such message, made concerning objects which on class of effects (responsibility) belong to objects with insignificant effects (CC 1), except the violations provided by part four of this Article

involve imposing of penalty from five hundred to six hundred free minima income of citizens.

Accomplishment of construction works without the permission on their accomplishment made concerning objects which on class of effects (responsibility) belong to objects with average effects (CC 2)

attracts imposing of penalty from one thousand to one thousand five hundred free minima of the income of citizens.

The act provided by part six of this Article, made concerning objects which on class of effects (responsibility) belong to objects with considerable effects (CC 3)

attracts imposing of penalty from two to three thousand free minima of the income of citizens.

Operation of the objects which are not accepted in operation, and also submission of doubtful data in the declarations on readiness of object for operation made concerning objects which construction was performed based on the construction passport

attract imposing of penalty from two hundred fifty to three hundred fifty free minima income of citizens.

Operation of the construction objects which are not accepted in operation, and also submission of doubtful data in the declarations on readiness of object for operation made concerning objects which on class of effects (responsibility) belong to objects with insignificant effects (CC 1), except the violations provided by part eight of this Article

involve imposing of penalty from five hundred to six hundred free minima income of citizens.

Operation of the construction objects which are not accepted in operation, and also the submission of doubtful data in the act of readiness of object for operation made concerning objects which on class of effects (responsibility) belong to objects with average effects (CC 2)

involve imposing of penalty from one thousand to one thousand five hundred free minima of the income of citizens.

The acts provided by part ten of this Article, made concerning objects which on class of effects (responsibility) belong to objects with considerable effects (CC 3)

involve imposing of penalty from two to three thousand free minima of the income of citizens.

Failure to provide the customer of implementation of designer's service if such supervision is obligatory according to requirements of the legislation,

attracts imposing of penalty from five hundred to one thousand free minima of the income of citizens.

Failure to provide the customer of implementation of technical supervision if such supervision is obligatory according to requirements of the legislation,

attracts imposing of penalty from five hundred to one thousand free minima of the income of citizens.

Non-presentation or untimely submission by the customer of information on transfer of the right to asset construction to other customer, change of the prime contractor or contractor, persons responsible for carrying out designer's and technical service, executives in charge of works, and also about adjustment of the project documentation if submission of such information is obligatory,

attracts imposing of penalty from two hundred to three hundred free minima income of citizens";

2) parts the first, third and fourth Article 96-1 to state in the following edition:

"Transfer of the project documentation to the customer for accomplishment of construction works on object developed with violation of requirements of the legislation, town-planning documentation, basic data for designing of objects, construction regulations, standards and rules including on creation of the free vital circle for persons physically challenged and other handicapped national groups, the indication of metering devices of water and heat energy, and also understating of class of effects (responsibility) of object

attract imposing of penalty on the chief architect of the project, the chief project engineer, the expert, other executives in charge of separate work types (services) connected with creation of objects of architecture who have the appropriate qualification certificate, from two to three thousand free minima of the income of citizens";

"Violation of terms of provision to the customer of town-planning conditions and restrictions, the construction passport of building of the parcel of land, the requirement at the customer of documents, not stipulated by the legislation, provision of such documents with violation of established procedure, town-planning documentation at the local level, construction regulations, standards and rules, violation of terms of provision to the customer of the conclusions (reports) of examination of project and town-planning documentation, provision of such conclusions (reports) with violation of established procedure, and also racketing when conducting examination of documents, not stipulated by the legislation,

involve imposing of penalty from five hundred to six hundred free minima income of citizens.
