About modification and amendments in the Criminal code of the Republic of Armenia

Article 1. In article 119 of the Criminal code of the Republic of Armenia of April 18, 2003 (further – the Code):

1) to state the title in the following edition:

"Article 119. Causing severe physical pain or strong sincere sufferings";

Part 1 to state 2) in the following edition:

"1. Intended causing to person of severe physical pain or strong sincere sufferings if it did not entail the effects provided by Articles 112 and 113 of this Code and if there are no stipulated in Article 309.1 of this Code essential elements of offense,

attracts imprisonment, for the maximum term three years.".

Article 2. Add the Code with Article 309.1 in the following edition:

"Article 309.1. Tortures

1. Intended causing by the official or other person having power to be provided to any person of severe physical pain or strong sincere sufferings on behalf of state body, or on their instigation, the order or from their permission, for the purpose of receipt of data or recognition at this or third party or for punishment for that act which made this or third party or of making of which it is suspected or accused, and also for the purpose of intimidation of this or third party or coercion to making of any action or abstention from its making or for any reason based on discrimination of any nature

attracts imprisonment, for a period of four up to eight years, with deprivation of the right to hold certain positions or to be engaged in certain activities, for the maximum term three years.

2. The same act which was made:

1) concerning two and more persons;

2) concerning the minor or person who is in material or other dependence on the criminal;

3) concerning the woman who is obviously in pregnancy condition;

4) group of persons or organized group;

5) with special cruelty;
