About modification and amendments in some orders of the Minister of health and social development of the Republic of Kazakhstan

According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:

1. Approve the list of some orders of the Minister of health and social development of the Republic of Kazakhstan to which changes and additions are made (further - the list) according to appendix to this order.

2. To provide to strategic development department of the Ministry of health and social development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction in one copy of its copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

4) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the responsible secretary of the Ministry of health and social development of the Republic of Kazakhstan Kurmangaliyeva A. D.

4. This order becomes effective after ten calendar days after day of its first official publication.

The list of some orders of the Minister of health and social development of the Republic of Kazakhstan to which changes and additions are made

1. In the order of the Minister of health and social development of the Republic of Kazakhstan of April 14, 2015 No. 223 "About approval of Rules of provision of the state base retirement benefit at the expense of budgetary funds, and also appointment and implementation of retirement benefits, public basic social benefits on disability, on the occasion of loss of the supporter and on age, the public special welfare payments from authorized organization" (it is registered in the Register of state registration of regulatory legal acts for No. 11110, it is published in information system of law of Ad_let on June 10, 2015):

in Rules of provision of the state base retirement benefit at the expense of budgetary funds, and also appointment and implementation of retirement benefits on age, the public basic social benefits on disability, on the occasion of loss of the supporter and on age, the public special welfare payments approved by the specified order:

state Item 3 in the following edition:

"3. Persons having the right to basic pension and retirement benefits on age (further - pensions), the public basic social benefits and the public special welfare payment (further - benefits) submit the application in form according to appendix 1 to these rules and for identification - the identity document.

In case of the request for purpose of pensions and the public basic social benefits of persons having the status of the oralman the copy of the certificate of the oralman before receipt of nationality is provided.

On purpose of retirement benefits on age, the public basic social benefits on disability and on the occasion of loss of the supporter, the public special welfare payment the application is submitted at the place of residence to department of the State corporation.

For purpose of basic pension and the public basic social benefit on age the application is submitted at the place of residence to department of the State corporation or through the portal.

In case of primary establishment of disability person addresses for purpose of the public basic social benefit on disability at the place of residence in division of medico-social examination (further - MSE) with the statement in form according to appendix 2 to these rules.

In case of reception of an application, data on the identity document, on registration on the permanent residence receive from the corresponding state information systems through lock of "the electronic government" (further - information systems):

In the absence of data from information systems the following documents are enclosed to the application:

identity document (passport of the citizen of the Republic of Kazakhstan, identity certificate of the citizen of the Republic of Kazakhstan, certificate of the stateless person, residence permit of the foreigner);

the document confirming registration on the permanent residence (the address reference or the reference of rural akims, for residents Baikonur - the reference of department of accounting and registration of citizens of housing of the city of Baikonur).

Data on bank account number in authorized organization for issue of pensions and benefits or about the control account of cash of organization of criminal executive system are also enclosed to the application.

For purpose of pensions and benefits to incapacitated, the statement is limited to the capable or needing guardianship or custody persons and necessary documents of the these rules specified in item 4 are filed by their legal representatives.

The statement for purpose of pensions and benefits the third parties moves by proxy, the Republic of Kazakhstan issued according to Article 167 of the Civil code.

Submission of the identity document of children, certificates of birth of child(children) or the statement from the birth record (on the registration made in the territory of the Republic of Kazakhstan after August 13, 2007), death certificates, the document confirming registration on the permanent residence of children, certificates on marriage (on the registration made in the territory of the Republic of Kazakhstan after June 1, 2008), the document on establishment of guardianship, the judgment on recognition of person is unknown absent (dead), adoption (adoption) of child(children) it is not required in case of confirmation of information containing in the specified documents, the state information systems";

in item 4:

"2) the documents confirming working life of the applicant:

service record;

references of archive organizations or from place of employment if records about labor activity are not made in the service record or are available corrections;

education document;

the military ID or the reference of management (department) for defense;

certificates of birth of children (the statement from the birth record, or the certificate of registration of the act of civil status, issued by bodies of civil registration).

If necessary (depending on their availability) are also represented:

the certificate of rehabilitation issued by bodies of prosecutor's office according to article 10 of the Law of the Republic of Kazakhstan "About recovery of victims of mass political repressions";

certificate of military commissariat of participation in fighting;

the judgment confirming the fact of implementation and the period of care of the disabled person of the first group, the lonely disabled person of the second group and the retirement pensioner, needing assistance, aged, reached eighty-year age, the disabled person aged up to sixteen years;

the document confirming accommodation abroad of the spouse (spouse) employee of the organizations which were in the territory of the Soviet Union, organizations of the Republic of Kazakhstan, the international organization;

the document confirming accommodation of the spouse (spouse) of the serviceman, employee of special state body in areas where there was no employment opportunity.

For confirmation of care of unemployed mother of juvenile children one of the following documents is submitted (depending on their availability):

identity document of children;

the marriage certficate (the certificate of civil registration) either the certificate on annulment of marriage or the statement from assembly record about marriage (in case of change of surname) children;

the certificate about the termination of average educational institution of children;

the diploma about the termination of specialized secondary or higher educational institution or the reference of educational institution confirming training of children;

the document confirming place of registration on the permanent residence of children;

the death certificate of children (or assembly record about death, or the certificate of registration of the act of civil status issued by bodies of civil registration);";

3) to state the subitem in the following edition:

"3) the marriage certficate (the certificate of civil registration) either the certificate on annulment of marriage or the statement from assembly record about marriage (in case of change of surname).";

state Item 13 in the following edition:

"13. In case of representation by the applicant of incomplete document package, and (or) documents with the expired effective period, lack of the right to purpose of pensions and benefits to the applicant the receipt on refusal in reception of an application on award of pension and benefits in form according to appendix 7 to these rules is instantly issued.";

add with Item 28-1 of the following content:

"28-1. The decision on refusal in purpose of pensions and benefits is accepted on the following bases:

1) establishment of unauthenticity of the documents submitted for purpose of the pensions and benefits and (or) these (data) containing in them;

2) discrepancy of the pensions and the benefits supplied provided for appointment and the information, to requirements, the established legal acts of the Republic of Kazakhstan.

in the Standard of the state service "Purpose of Retirement Benefits on Age" approved by the specified order:

state item 4 in the following edition:

"4. Term of rendering the state service:

1) from the moment of registration of document package in the State corporation - 10 (ten) working days.

The term of rendering the state service is prolonged:

in the presence of the bases for check of reliability of the provided document(s), including from information systems - for 5 (five) working days;

in need of reclamation of the additional document(s) - up to 30 (thirty) working days, at the same time the State corporation notifies the applicant on need of submission of the additional document(s) - 5 (five) working days;

2) on the portal - 30 minutes from the moment of receipt of electronic request in information system;

3) the most allowed time of expectation for delivery of document package in the State corporation - 15 minutes;

4) the most allowed time of servicing in the State corporation - 30 minutes";

state Item 9 and 10 in the following edition:

"9. Uslugopoluchatel (or his representative under the notarized power of attorney) in case of the address for rendering the state service provides the statement on form according to appendix 1 to this standard of the state service and the following documents:

in the State corporation:

1) the identity document (the passport of the citizen of the Republic of Kazakhstan, the identity certificate of the citizen of the Republic of Kazakhstan, the certificate of the stateless person, the residence permit of the foreigner, the certificate of the oralman before receipt of nationality of the Republic of Kazakhstan) (it is required for identification of the personality);

2) the document confirming registration on the permanent residence (the address reference or the reference of rural akims, for residents Baikonur - the reference of department of accounting and registration of citizens of housing of the city of Baikonur);

3) the document on bank account number in banks of the second level, the organization having the license of authorized body on regulation and supervision of the financial market and the financial organizations on the corresponding types of banking activities, territorial subdivision of Kazpochta joint-stock company or about the control account of cash of organization of criminal executive system;

4) the certificate of the income amounts paid to physical person and performed from the income of compulsory pension contributions in form according to appendix 2 to this standard of the state service or the document on the income of individual entrepreneurs, lawyers, private notaries, private legal executives and professional mediators issued by body of state revenues.

In case of liquidation of the organization (company) the archive reference with indication of data on the income is submitted.

Persons working in the Russian organizations of the Baikonur complex the certificate of the employer of the income paid in currency of the Russian Federation is submitted;

5) the documents confirming working life of the applicant:

service record;

references of archive organizations or from place of employment if records about labor activity are not made in the service record or are available corrections;

education document;

the military ID or the reference of management (department) for defense;

certificates of birth of children (the statement from the birth record, or the certificate of registration of the act of civil status, issued by bodies of civil registration).

Depending on availability the following documents are submitted:

the certificate of rehabilitation issued by bodies of prosecutor's office according to article 10 of the Law of the Republic of Kazakhstan "About recovery of victims of mass political repressions";

certificate of military commissariat of participation in fighting;

the judgment confirming the fact of implementation and the period of care of the disabled person of the first group, the lonely disabled person of the second group and the retirement pensioner needing assistance, aged, reached eighty-year age, the disabled person aged up to sixteen years;

the document confirming accommodation abroad of the spouse (spouse) employee of the former Soviet organizations, organizations of the Republic of Kazakhstan, the international organization;

the document confirming accommodation of the spouse (spouse) of the serviceman, employee of special state body in areas where there was no employment opportunity.

6) the marriage certficate (the certificate of civil registration) either the certificate on annulment of marriage or the statement from assembly record about marriage (in case of change of surname of the parent/guardian).

In case of purpose of retirement benefits on age to the women who gave rise (adopted, adopted) 5 and more children and brought up them to eight-year age, are in addition represented certificates of birth of children (either the birth record, or the certificate of registration of the act of civil status issued by bodies of civil registration) and the documents confirming the fact of education of children up to eight years.

For confirmation of the fact of education of children up to eight years (depending on their availability), documents according to Item 5 of Rules of provision of the state base retirement benefit at the expense of budgetary funds, and also appointment and implementation of retirement benefits, public basic social benefits on disability, on the occasion of loss of the supporter and on age, the public special welfare payments from authorized organization approved by the order of the Minister of health and social development of the Republic of Kazakhstan of April 14, 2015 No. 223 are submitted (it is registered in the Register of state registration of regulatory legal acts for No. 11110).

In case of purpose of retirement benefits on age to person living in zones of extreme and maximum radiation risk the document confirming the accommodation fact in zones of extreme and maximum radiation risk from August 29, 1949 to July 5, 1963 within 5 years is in addition submitted.

In case of establishment of guardianship (guardianship), the document confirming establishment of guardianship (guardianship) is submitted.

Submission of the identity document of uslugopoluchatel, the certificate of birth of child(children) or the statement from the birth record (on the registration made in the territory of the Republic of Kazakhstan after August 13, 2007), the document confirming registration on the permanent residence, certificates on marriage (on the registration made in the territory of the Republic of Kazakhstan after June 1, 2008), the document on establishment of guardianship (guardianship), the judgment about adoption (adoption) of child(children) is not required in case of confirmation of information containing in the specified documents, the state information systems;

on the portal:

request in electronic form, the uslugopoluchatel certified by the EDS.

Data on the identity document, the uslugopoluchatel receives from the corresponding state information system through lock of "the electronic government".

The employee of the State corporation receives the written consent of uslugopoluchatel to use of the data which are the secret protected by the law, containing in information systems when rendering the state services if other is not provided by the laws of the Republic of Kazakhstan.

When giving the uslugopoluchatel of all required documents to uslugopoluchatel issues the receipt on acceptance of the relevant documents.

In case of the address through the portal - in "personal account" of uslugopoluchatel the status about acceptance of request for rendering the state service is displayed.

The result of rendering the state service is issued in case of presentation of the identity document in case of personal visit of uslugopoluchatel (or his representative under the notarized power of attorney) based on the receipt on acceptance of the relevant documents.

The state corporation informs uslugopoluchatel on the made decision by means of transfer of the SMS notification on the mobile phone of uslugopoluchatel.

10. In provision cases the uslugopoluchatel of incomplete document package according to the list, stipulated in Item 9 these standards of the state service, and (or) documents with the expired effective period, lack of the right to purpose of retirement benefit on age, the employee of the State corporation issues the receipt on refusal in reception of an application on appointment in form according to appendix 3 to this standard of the state service.

In case of receipt of the data from information system confirming the fact of purpose of the corresponding payment or filing of application to award of pension and benefits, the employee of the State corporation instantly hands to the applicant the receipt on refusal in reception of an application in form according to appendix 4 to this standard of the state service.";

"10-1. The service provider refuses rendering the state services in the following bases:

1) establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them;
