About modification of the Instruction on the organization of work of bank system in the extraordinary mode

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", for the purpose of ensuring functioning of bank system of Ukraine and uninterrupted financing of needs of the state and life activity of the population in the conditions of extraordinary operating mode the Board of the National Bank of Ukraine decides:

1. Make changes to the Instruction on the organization of work of bank system in the extraordinary mode approved by the resolution of Board of the National Bank of Ukraine of July 22, 2014 No. 435 (with changes), having been reworded as follows it which is applied.

2. To department of safety of the National Bank of Ukraine (Skomarovsky A. A.) bring contents of this resolution to the attention of the Public treasurer service of Ukraine and banks of Ukraine for use in work.

3. I reserve control over the implementation of this resolution.

4. The resolution becomes effective from the date of, its official publication following behind day.

The instruction on the organization of work of bank system in the extraordinary mode

I. General provisions

1. This Instruction is developed according to requirements of the Constitution of Ukraine, the Code of civil protection of Ukraine, the Law of Ukraine "About the National Bank of Ukraine", other acts of the legislation and regulatory legal acts of the National Bank of Ukraine (further - National Bank).

2. This Instruction determines procedure for carrying out banking activities, the description of changes in technologies of their carrying out, single questions of the organization of activities of National Bank, banks of Ukraine (further - banks), and also actions of the employees of National Bank connected with accomplishment of such transactions in case of the emergency mode that makes impossible work of bank system regularly (further - extraordinary operating mode).

3. Requirements of this Instruction extend to National Bank, banks and non-bank participating organizations of electronic payment system (further SEP) in case of introduction of extraordinary operating mode.

4. The board of National Bank makes the decision on creation of the commission (working group), determines its structure, distribution of powers and effective periods.

5. The following questions belong to powers of the commission (working group), in particular:

1) coordination of works on ensuring continuous work and recovery of activities of bank system;

2) coordination of work of bank system with cash, decision making on the questions arising during extraordinary operating mode;

3) ensuring interaction with banks, the Public treasurer service of Ukraine and coordination of collateral actions for implementation of payment under their orders;

4) interaction with law enforcement and other state bodies;

5) organization of necessary assistance to employees of National Bank.

The commission (working group) makes decisions on other questions arising during extraordinary operating mode and recovery of activities of bank system.

6. The board of National Bank has the right to make the decision on suspension, will lock activities of banks or implementation of separate transactions.

7. Directors of departments, the Central clearing house, the Central storage, the State Treasury of Ukraine, the CEO of Banknote mint, the representative of National Bank in regions of Ukraine (other employee of National Bank based on the order of National Bank), have the right to determine the action plan and/or to make the decision for ensuring work of division depending on the circumstances which arose in the conditions of extraordinary operating mode and to approve it with the commission (working group).

For development and taking measures to providing the organization of work the special commissions in regions of Ukraine can be created.

8. Banks make the decision on plan development of actions, creation of the commissions (working groups), determination of procedure for internal bank procedures of implementation of transactions in the conditions of extraordinary operating mode, and also on activities recovery. Banks approve the corresponding action plans with the commission (working group) of National Bank as required.

9. The chairman, the first deputy and vice-chairmen of National Bank, representatives of National Bank in regions of Ukraine [chiefs of departments (management) of currency circulation in regions / other employee of National Bank based on the order of National Bank], the director of the Central clearing house, the general director / deputy director general of Banknote mint, directors/associate directors of the Central storage, State Treasury of Ukraine (further - the Head) and heads of banks in case of introduction of extraordinary operating mode shall take first of all the measures aimed at providing safety of life and health of workers.

10. The head/head of bank depending on situation, makes the decision relatively:

1) strengthenings of protection of bank, the organization of interaction with divisions of the Ministry of Internal Affairs of Ukraine for the purpose of non-admission of penetration of strangers on the territory of bank, their intervention in working process;

2) carrying out evacuation of workers, material and cultural values according to developed plans of evacuation;

3) taking measures for ensuring protection and safety of assets, seals, stamps of bank, other values, accounting information on transactions of banks, source documents and bookkeeping registers and so forth;
