About refugees

This Law determines legal status of the refugee in Ukraine, procedure for provision, loss and deprivation of the status of the refugee, establishes the state guarantees of protection of refugees.

Section I. GENERAL PROVISIONS

Article 1. Determination of terms

In this Law terms are used in the following value:

the refugee - person who is not citizen of Ukraine and owing to quite reasonable concerns to fall victim of prosecutions on signs of race, religion, nationality, nationality (citizenship), belonging to certain social group or political convictions, is outside the country of the civil accessory and cannot use protection of this country or does not wish to use this protection owing to such concerns, or, without having nationality (citizenship) and being outside the country of the previous permanent residence, cannot or does not wish to return to it owing to the specified concerns;

the country of civil accessory - the country, the citizen (citizen) of which person is. Under condition when person has over one nationality, it is considered having protection of the country of the civil accessory if without any reasonable excuse following from reasonable concerns it did not use protection of one of the countries, the citizen (citizen) of which it is;

the country of permanent residence of the stateless person - the country in which the person without citizenship constantly lived before arrival in Ukraine;

country of source of the refugee - the country of civil accessory to the foreigner or the country of permanent residence for the stateless person concerning which such persons have reasonable concerns to become the victims of prosecutions on the signs determined in the paragraph the second article 1 of this Law;

the third safe country - the country in which person was before arrival in Ukraine except as specified of transit through the territory of such country, and could address with the petition for recognition by the refugee or asylum as such country;

observes international standards on human rights in the field of shelter which are established by international legal acts of universal and regional nature, including regulations about prohibition of tortures, inhuman either degrading treatment or punishment;

observes the international principles concerning protection of refugees provided by the Convention on the status of refugees of 1951 and the Protocol on the status of refugees of 1967, considering the principle of not dispatch;

has the national legal system in the field of shelter and refugees, and its relevant state bodies determine the status of the refugee and grant shelter;

will provide to person effective protection against dispatch and opportunity to address for shelter and to use it;

agrees to accept person and to provide it access to the procedure of determination of the status of the refugee or provision of shelter;

members of the family of the refugee - the husband (wife), children who did not perform eighteen years, disabled parents and other persons which are under guardianship or care of the refugee;

legal representatives of the minor who did not reach eighteen years, - parents, adoptive parents, the grandfather or the grandma, the full age brother or the sister, guardians or custodians appointed those before arrival in Ukraine, other full age faces which before arrival in Ukraine voluntarily or owing to custom of country of source of the refugee took the responsibility for education of children;

legal representatives of the child separated from family - guardianship and custody body, the parents tutors, guardians or custodians appointed according to the legislation of Ukraine, the representative of orphanage or boarding school, other child care facility where the child is on education;

the child separated from family - the person aged up to eighteen years which is arriving or arrived to the territory of Ukraine without parents or one of them, the grandfather or the grandma, the full age brother either the sister, or the guardian or the custodian appointed according to the legislation of country of source of refugees, or other full age persons who before arrival in Ukraine voluntarily or owing to custom of country of source of the refugee took the responsibility for education of the child;

legal representatives of incapacitated person are guardians;

the certificate of the refugee - the passport identity document of its owner and the confirming provision fact to it in Ukraine of the status of the refugee and being valid for realization of the rights and fulfillment of duties provided by this Law and other laws of Ukraine;

temporary accommodation center of refugees - the place of temporary accommodation of persons who submitted the application for provision of the status of the refugee on whom the decision on document creation for the solution of question of provision of the status of the refugee is made and to which the status of the refugee is provided in Ukraine;

identification of the personality - the actions connected with establishment of the identity of the applicant by executive bodies who filed petition for provision to it the status of the refugee in Ukraine and has no the documents proving his identity either such documents counterfeit or false;

the certificate of submission by person of the statement for provision to it the status of the refugee - the document certifying legality of stay of person in the territory of Ukraine for action of the reference and being valid for realization of the rights and fulfillment of duties provided by this Law and other laws of Ukraine;

the certificate of face on which the decision on document creation for the solution of question of provision to it the status of the refugee is made, - the document certifying legality of stay of person in the territory of Ukraine for action of the reference and being valid for realization of the rights and fulfillment of duties provided by this Law and other laws of Ukraine;
