About entering of amendments into the Criminal code of the Republic of Armenia

Article 1. To add the criminal code of the Republic of Armenia of April 18, 2003 (further – the Code) with Article 190.1 of the following edition:

"Article 190.1. Unfair use of internal information

1. Acquisition by the insider of securities or the related derivative tools or their sale based on internal information or illegal provision of internal information to the third parties as a result of which he got profit in considerable size attracts infliction of penalty, from the thousandfold size of minimum wage, thousandfold to two, or deprivation of the right to hold certain positions or to be engaged in certain activities, for a period of two up to four years.

2. The act provided by part of 1 this Article:

As a result of which 1) income in the large sizes is gained;

2) which was made by group of persons:

attracts deprivation of the right to hold certain positions or to be engaged in certain activities, for a period of four up to seven years, or imprisonment, for a period of two up to four years, with confiscation of property or without confiscation.

3. The act provided by part of 1 this Article:

As a result of which 1) income in especially large sizes is gained;

2) which was made by group of persons;

3) which was made with use of official position:

attracts imprisonment, for a period of four up to seven years, with confiscation of property or without confiscation.

4. In this Article and Article 190.2 of this Code the amount (cost) exceeding twenty thousandfold size of the minimum wage established at the time of crime execution is considered the considerable size.

In this Article and Article 190.2 of this Code the amount (cost) exceeding thirty thousandfold size of the minimum wage established at the time of crime execution is considered the large size.
