About entering of amendments into Article 118 of the Code of penal procedure of the Republic of Moldova No. 122-XV of March 14, 2003

In Article 118 of the Code of penal procedure of the Republic of Moldova No. 122-XV of March 14, 2003 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 248-251, 699), with subsequent changes and amendments to make the following additions:

part (1) after word of "documents", to add with words "computer systems or devices for storage of computer data,";

add Article with parts (5) – (7) the following content:

"(5) the Criminal prosecution authority performs inspection of computer systems or devices for storage of computer data in case of need by means of the specialist in the field.

(6) According to the statement of person who owns or exercises control over the objects containing computer data, criminal prosecution authority the motivated resolution disposes about copying which serve as evidentiary fact. Copies are carried out with use of the methods and technical means providing integrity and authenticity of computer data.

(7) In case survey of the objects containing computer data requires more long time or when production of examination or receipt of the scientific and technical conclusion on computer systems or devices is necessary for storage of computer data, person performing criminal prosecution carries out dredging of the corresponding objects for their studying in criminal prosecution authority or the order about conducting examination or making the scientific and technical conclusion. For this purpose the objects containing computer data are packed and sealed, and the packet is signed about what the mark in the protocol becomes.".
