About modification of some legal acts of Ukraine governing the relations connected with receipt of documents of allowing nature concerning special water use

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Water code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 1995, No. 24, the Art. 189):

Item 5 of Article 8-1 to exclude 1);

Shall be replaced with words 2) in Item 7 of Article 14 of the word "and also procedure for development and approval of standard rates" "and also procedure for development of standard rates";

Item 9 parts one of Article 16 to state 3) in the following edition:

"9) issue of permissions to special water use";

Item 4 of Article 17-1 to exclude 4);

Item 1 of Article 17-2 - to exclude 5);

To exclude 6) in part two of Article 38 of the word "and approval";

7) in Article 42:

the fourth and fifth to state parts in the following edition:

"Secondary water users (subscribers) are those which have no own water intaking constructions and receive water from water intaking constructions of primary water users and dump sewage in their systems based on the agreement on water supply (water supply) and/or on water disposal without receipt of permission to special water use.

Secondary water users perform dumping of sewage into water objects based on permissions to special water use";

add with part six of the following content:

"The intake and use of water from canals, water supply systems (water supply systems) interbasin and intra basin water resources of redistribution are performed based on permission to special water use and the agreement on water supply (water supply) signed with the companies and the organizations which provide transfer of water to shallow regions. The list of the companies and organizations providing transfer of water to shallow regions affirms the Cabinet of Ministers of Ukraine";

8) in Article 48 part three:

to add the paragraph of the eighth after the word "accomplishment" with words of "clearing of beds of the rivers, channels and bottom of reservoirs";
