The governments of the State Parties of this agreement which are hereinafter referred to as with the Parties

proceeding from objective need of preserving and development of economic and scientific and technological cooperation in the field of selection and seed farming for the purpose of increase in efficiency of agricultural production,

in view of need of assistance to effective protection of plant varieties,

attaching importance to creation and mutual transfer on the state testing of highly productive and high-quality plant varieties,

recognizing need of cooperation of the Parties in the field of protection of selection achievements of the states,

aiming at development of mutually advantageous trade in seeds and landing material of crops,

agreed as follows:

Article 1

For the purposes of this agreement the used terms have the following values:

plant variety (grade) - group of plants, within the lowest of the known botanical taxons which can:

- to be determined by extent of manifestation of the signs which are result of realization of this genotype or combination of genotypes;

- be expressiveness degree, distinguishable from any other group of plants, at least of one of these signs;

- be considered as a unit from the point of view of its suitability for reproduction in invariable type of the whole plants of grade.

The protected categories of grade are the clone, the line, hybrid of the first generation, population;

the protected grade - the plant variety registered in the state registers of the Parties;

joint plant variety - the plant variety created on the basis of joint international programs within agreements, agreements, contracts or other arrangements;

the applicant - legal entity or physical person which submitted the application for issue of the document certifying the property right to plant variety;

the security document - the document of competent authority certifying the right to grade;

the owner - legal entity or physical person which property right is based on the security document.
