About modification and amendments in the Instruction about bank transfer

Based on paragraphs of the twentieth, twenty sixth 26, Article parts one 39, parts three of article 232 of the Bank code of the Republic of Belarus the Board of National Bank of the Republic of Belarus DECIDES: Articles

1. Bring in the Instruction about bank transfer approved by the resolution of Board of National Bank of the Republic of Belarus of March 29, 2001 No. 66 (The national register of legal acts of the Republic of Belarus, 2001, No. 49, 8/5770; National legal Internet portal of the Republic of Belarus, 20.01. 2013, 8/26794; 20:05. 2014, 8/28669; 25.12. 2014, 8/29406; 04:06. 2016, 8/30957), following changes and amendments:

1.1. in Item 2 part one:

in the paragraph the second shall be replaced with words the words "or in electronic form" ", in the form of the electronic document or the electronic message";

the forty first after words of "the electronic document" to add the paragraph with the words "or electronic message";

to state the paragraph of the forty second in the following edition:

"the electronic message - the message created by means of the software and hardware and technologies applied under the agreement of bank with the client, and containing information necessary for implementation of the bank transfer, data on execution of payment instructions, condition of accounts, other data provided by terms of the contract, concluded between bank and the client.";

1.2. state Item 3 in the following edition:

"3. Payment instructions, and also other documents provided by this Instruction (further - other documents), are created and represented to banks on paper, in the form of electronic documents or electronic messages by means of systems of remote bank servicing.

The method of forming of payment instructions (the document processed on paper, the electronic document, the electronic message), type of system of remote bank servicing are determined by the legislation or the agreement signed between bank and the client.";

1.3. state Item 5 in the following edition:

"5. Settlement documents shall contain details and marks according to appendices 1-3 to this Instruction.

Settlement documents (except for the payment order) in the form of the electronic document are created and reproduced according to the technical regulatory legal acts of National Bank establishing requirements to processes of creation and reproduction on paper of the electronic documents used for making of banking activities.

Execution of settlement documents (except for the payment order) is on paper performed in the forms of external submission of electronic settlement documents provided by the technical regulatory legal acts of National Bank establishing requirements to processes of creation and reproduction on paper of the electronic documents used for making of banking activities.

Payment orders shall be drawn up:

in form according to appendix 4 to this Instruction - when carrying out the international and account bank transfers;

in form according to appendix 4-1 to this Instruction - when carrying out account bank transfers.

The settlement documents processed on paper and also the electronic settlement documents reproduced on paper (further - the copy of the settlement document), except for the summary payment order and the payment order, shall keep form, integrity and not to exceed the size of the sheet A4 (210 x 297 millimeters). For the purpose of the automated processing of the settlement documents processed on paper banks can include in fields additional subfields in the procedure determined by them.

"Out of fields of the settlement document, and also register of the payment requests in form according to appendix 11 to this Instruction which are drawn up on paper drawing barcode, other information necessary for bank according to the procedure determined by bank is possible.";

1.5. in Item 7:

the fourth and fifth to state parts in the following edition:

"The documents provided by parts of first or third of this Item and created in the form of electronic documents are signed by digital signatures (signature) of official faces of the legal entity, digital signatures of the individual entrepreneur, notary, lawyer, physical person, authorized persons of bank when implementing transfers from bank name.

The documents provided by parts of first or third of this Item, created in the form of electronic messages are confirmed by the legal entities authorized by persons (ohms) of bank in case of transfers from bank name, the individual entrepreneur, the notary, the lawyer, physical person using software and hardware and technologies.";
