About modification of Conditions and Rules of implementation of business activity on delivery of electrical energy on regulated rate

According to the Laws of Ukraine "About power industry", "About natural monopolies", the Presidential decree of Ukraine of November 23, 2011 No. 1059 "About the National commission performing state regulation in the field of power" the National commission performing state regulation in the field of power decides:

1. Bring in Item 3.6 of Chapter 3 of the Conditions and Rules of implementation of business activity on delivery of electrical energy on regulated rate approved by the resolution of the National commission of regulation of power industry of Ukraine of June 13, 1996 No. 15/1, registered in the Ministry of Justice of Ukraine on August 8, 1996 for No. 433/1458, the following changes:

Subitem 3.6.3 to add 1) with the new paragraph of the following content:

"In case of application of the stimulating regulation rates for electrical supply are established according to separate solutions of NKRE.";

2) the first offer of subitem 3.6.4 to state in the following edition: "NKRE has the right to review, adjust rates in case of identification of inappropriate use of the means provided in the approved rates, failures to carry out of investing program, provision by the licensee in NKRE of unreliable information concerning implementation by it of licensed activities, identification of the facts of non-compliance with requirements when forming the list of assets for carrying out independent assessment and determination of regulatory base of assets, mistakes when calculating the necessary income for implementation of activities for delivery of electrical energy on regulated rate and in other cases provided by normative legal acts of NKRE.".
