About tourism

This Law determines general legal, organizational and social and economic basis of realization of state policy of Ukraine in the field of tourism and is aimed at providing the rights of citizens to rest, freedom of travel, health protection, to the environment, satisfaction of spiritual needs and other rights, safe for life and health, affirmed by the Constitution of Ukraine when implementing tourist travel. He establishes bases of rational use of tourist resources and governs the relations connected with the organization and implementation of tourism in the territory of Ukraine.

Section I General provisions

Article 1. Determination of terms

In this Law the stated below terms are used in the following value:

tourism - temporary departure of person from the residence in improving, cognitive, professional and business or other purposes without implementation of paid activities in the place where person leaves;

the tourist - person performing travel across Ukraine or to other country from the adoptive state which is not prohibited by the law the purpose for a period of 24 hours up to one year without implementation of any paid activities and with the obligation to leave the country or the place of stay in the specified time;

tourist product - previously developed complex of tourist services combining at least two such services which is implemented or offered for realization at the determined price which part transportation services, the services of placement and other tourist services which are not connected with transportation and placement are (services in the organization of visits of objects of culture, rest and entertainments, realization of souvenirs, etc.);

the accompanying tourist services and goods - the services and goods intended for requirements satisfaction of consumers whose rendering and production will insignificantly be reduced without their realization to tourists;

characteristic tourist services and goods - the services and goods intended for requirements satisfaction of consumers whose rendering and production will significantly be reduced without their realization to tourists;

promotion of tourist product - package of measures, directed to creation and preparation for realization of tourist product or tourist services (the organization of advertizing and fact-finding travel, participation in specialized exhibitions, fairs, the edition of catalogs, booklets, etc.);

the place of sale (realization) of tourist services - the country in which the appropriate subject of managing realizing tourist product is registered;

the place of rendering tourist services - the country in the territory of which tourist services are directly rendered;

means of temporary placement - the single property complex used for implementation of activities for rendering services of temporary placement;

service of temporary placement - action (transaction) of the subject of managing for temporary accommodation of the consumer by provision of number (place) for temporary placement, and also other services which are directly connected with temporary placement;

hotel - the means of temporary placement consisting of six and more numbers and in which the subject of managing provides hotel services. Types of hotels are determined by the Cabinet of Ministers of Ukraine;

hotel service - actions (transaction) of the subject of managing for temporary accommodation of the consumer by provision of room (place) in hotel, and also the additional services provided to the consumer according to category of hotel.

Article 2. Legislation of Ukraine on tourism

The legislation of Ukraine on tourism consists of the Constitution of Ukraine, this Law, other regulatory legal acts published according to them.

The property relations in the tourism industries based on equality, autonomy of will and property independence of their participants are regulated Civil and Economic by codes of Ukraine taking into account the features established by this Law.

If the international treaty of Ukraine which consent to be bound is this the Verkhovna Rada of Ukraine, provides other rules, than those that are established by this Law, rules of the international treaty are applied.

Article 3. Tourist resources of Ukraine

1. Tourist resources of Ukraine are offered or such which can be offered tourist offers on basis and with use of objects of the state-owned, utility or private property.

The directions of development and development of tourist resources of Ukraine are determined by public authorities, local government bodies according to development programs of tourism.

Classification and assessment of tourist resources of Ukraine, the mode of their protection, procedure for use taking into account maximum allowable loads on objects of cultural heritage and the environment, procedure for preserving integrity of tourist resources of Ukraine, measure for their recovery are determined according to the law.

Unique tourist resources can be on the specific mode of protection limiting access to them. Restriction of access to tourist resources is determined by their real handling capacity, level of permissible anthropogenous load, seasonal and other conditions.

In case of town-planning planning, designing, placement, construction and reconstruction of objects of town planning in the territories of recreational zones relevant organs of the executive authority, owners of objects of town planning shall provide the maximum integration of objects under construction into the local social and economic, natural and historical and cultural circle.

Article 4. Organizational forms and types of tourism

Organizational forms of tourism are the international and internal tourism.

Depending on categories of persons performing tourist travel (trips, visits), their purposes, objects which are used or visited or other signs there are following types of tourism:

children's;

youth;

family;

for elderly people;

for persons with disability;

cultural and cognitive;

medical and improving;

sports;

religious;

ecological (green);

rural;

underwater;

mountain;

adventure;

hunting;

automobile;

amateur, etc.

Features of implementation of separate types of tourism are established by the law.
