About modification and amendments in some legal acts
The Parliament adopts this organic law.
Art. I. – In the Law on National Bank of Moldova No. 548/1995 (repeated publication: The official monitor of the Republic of Moldova, 2015, Art. No. 297-300, 544), with subsequent changes and amendments to make the following changes and addition:
1. To add article 2 after the concept "Debt obligation" with new concept of the following content:
"Infrastructure of the financial market – the multilateral system between participants and her operator operating within general rules, formal and standardized, used for the purpose of calculations, clearing (compensation) or registration of payments, securities, derivative financial instruments or other financial transactions.".
2. In part (1) Article 5:
Item f) to state in the following edition:
"f) establishes, licenses, performs, regulates and controls activities of infrastructures of the financial market in the procedure established by the law and promotes their stable and effective functioning;";
Item n) to declare invalid.
3. In part (4) Article 34 of the word "Single Central Depositary" shall be replaced with words "Single Central Securities Depository".
4. Item b) Article 40 to declare invalid.
5. To state the name of Chapter VI-1 in the following edition:
"Chapter VI-1. Infrastructures of the financial market".
6. State Article 49-2 in the following edition:
"Article 49-2. Single Central Securities Depository
The National Bank establishes, exercises regulation and supervision of activities of Single Central Securities Depository according to the Law on Single Central Securities Depository No. 234/2016.".
7. In part (1) Article 69 of the word "in four-months time upon termination of each financial year", shall be replaced with words "till June 1,".
8. Item e) parts (Article 71 to state 2) in the following edition:
