The government of the Republic Georgia and the Government of Ukraine ("Contracting parties" hereinafter are referred to as further), wishing to strengthen economic cooperation on the long-term basis for mutual advantage of both Contracting Parties, having

intentions to create and support favorable conditions for investors of one Contracting Party in the territory of the second Contracting Party,

recognizing that assistance and mutual protection of investments in connection therewith will stimulate with the Agreement business initiative in this area,

agreed about the following:

Article 1 Determination

For the purposes of this Agreement:

1. The term "investment" will cover any kind of the assets invested in connection with economic activity by the investor of one Contracting Party in the territory of the second Contracting Party by the current legislation of the last will not include in particular but not only:

a) personal and real estate, as well as other rights, such, as mortgage, the providing rights according to the loan and other similar rights;

b) shares, securities and debt obligations of legal entities or property parts of these legal entities;

c) the loans, the credits, target bank and financial contributions and other monetary claims connected with implementation of investments;

d) intellectual property rights, including the copyright, trademarks, patents, industrial designs, engineering procedures, know-how, commercial secrets, brand names and goodwill connected with investments;

e) licenses and permissions according to the legislation, including concessions on investigation, production, development and operation of natural resources;

Any change of form in which assets were invested will not influence their nature as investments.

2. The term "investor" will mean any physical person or legal entity which invests on the territory of the second Contracting Party:

a) The term "physical person" will mean any physical person who is citizen of the Contracting Party according to the legislation of this Contracting Party;
