About modification of some legal acts of the Kyrgyz Republic (in the laws of the Kyrgyz Republic "About the national pension social insurance" and "About minimum wage in the Kyrgyz Republic")

Article 1. Bring in the Law of the Kyrgyz Republic "About the national pension social insurance" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 1997, No. 8, the Art. 392) the following changes:

Item 4 of Article 7 to state 1) in the following edition:

"4. For the purpose of ensuring protection of interests of pensioners indexation of insurance parts of pension is carried out. Condition of carrying out indexation of insurance parts of pension is growth of size of the average salary and the consumer price index which developed for the calendar year preceding indexation.

The coefficient of indexation of the sizes of insurance parts of pensions makes size at least average value from the amount of consumer price index and growth of the average monthly salary which developed for the previous calendar year. At the same time the amount of indexation constitutes at least growth of size of subsistence minimum of the pensioner for the previous calendar year.

Indexation of pensions is carried out annually within the means provided in the budget of Social fund. The procedure for indexation of pensions is determined by the Government of the Kyrgyz Republic.";

Article 17 to add 2) with item 4 of the following content:

"4. The size of general pension of the disabled person of the I group is established not lower than the size of subsistence minimum of the pensioner who actually developed for the previous calendar year.";

Item 5 of Article 22 to state 3) in the following edition:

"5. The amount of the cumulative fees for the entire period of their payment considered in conditional part of the personal insurance account annually is indexed depending on the size of consumer price index which actually developed for the previous calendar year.";
