About entering of amendment into the Code of civil procedure of the Republic of Moldova No. 225/2003

Code of civil procedure of the Republic of Moldova No. 225/2003 (repeated publication: 2013, Art. No. 130-134, 415), with subsequent changes and amendments to add the official monitor of the Republic of Moldova with Chapter XIII1 of the following content:

"Chapter XIII-1. Judicial mediation

Article 182-1. Judicial mediation

(1) Judicial mediation is obligatory method of permission peaceful manner of the requirements submitted to degree of jurisdiction with the help and under the direction of degree of jurisdiction in the cases connected with:

a) consumer protection;

b) family disputes;

c) disputes between physical persons and/or legal entities of private law on the property rights to property;

d) employment disputes;

e) the disputes arising from the tort liability;

f) heritable disputes;

g) other civil disputes which cost constitutes less than 200000 lei, except for disputes in which the executive decree on initiation of the procedure of insolvency is issued.

(2) According to the petition of the parties judicial mediation can be performed also in other cases in addition to provided by part (1).

(3) the Voluntary settlement of the parties is possible also out of judicial mediation according to this code.

Article 182-2. Procedure of judicial mediation

(1) After acceptance to consideration of the action for declaration according to part conditions (4) articles 168 the degree of jurisdiction in five-day time establishes for the parties of process date of meeting on peaceful resolution of dispute. In the presence of the proof about the notice of the parties in the procedure established by the law their absence at meeting on peaceful resolution of dispute does not influence the current of the term provided by part (5) this Article.

(2) during the meeting on peaceful resolution of dispute the degree of jurisdiction informs the parties on the law applied on this dispute, durations of procedures, possible court costs, the possible solution of case and its effects for the parties of process.
