About modification and amendments in some legal acts

The Parliament adopts this organic law.

Art. I. – In the Security act of traffic No. 131/2007 (repeated publication: The official monitor of the Republic of Moldova, 2015, Art. No. 11-21, 6), with subsequent changes and amendments to make the following additions:

1. In Article 2:

after the concept "official train" to add Article with the concept "aggressive driving" of the following content:

"aggressive driving – conscious implementation by the transport driver of consecutive actions or maneuvers, stipulated in Item d) parts (3) article 33 of this law, Traffic regulations which are not corresponding to provisions or regulations of provident driving by means of what it creates unreasonable hindrances to movement, infringes at the rights of other participants of traffic or forces them to take additional measures preventing the road accident or not to threaten traffic safety;";

after the concept "driver" to add Article with the concept "provident driving" of the following content:

"provident driving – the actions of the transport driver according to provisions of Traffic regulations providing prevention of the road accidents by non-admission of dangerous situations in case of vehicle control and also anticipation and avoidance of dangerous situations which can be provoked by other participants of traffic;".

2. Part (Article 33 to add 3) with Item d) the following content:

"d) apply during traffic of regulation of provident driving and not show the elements of aggressive driving which are expressed in such actions as:

1) consecutive movement with abuse of regulations of evolution from one strip on another for the purpose of overtaking, detour of vehicles;

2) implementation of turn with use of the brake system;

3) start of motion by sharp dispersal of the vehicle;

4) intimidation of the transport driver by repeated or permanent excessive approach behind or sideways, uses of obscene gestures, obscene words or expressions;
