About modification of some legal acts of the Kyrgyz Republic (in the laws of the Kyrgyz Republic "About electric and mail service", "About licensed authorization system in the Kyrgyz Republic", "About television and broadcasting")

Article 1. Introduce in the Law of the Kyrgyz Republic "About electric and mail service" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 1998, No. 8, the Art. 230a) the following changes:

1) in Article 2:

a) in the text in state language paragraphs of the eighth, twenty second, twenty sixth to recognize invalid;

b) in the text in official language paragraphs of the seventh, twenty second, twenty sixth to recognize invalid;

"Services of means mass information - forming of the electric signal of teleradio channels intended for distribution on networks of electric communication irrespective of the applied technologies. Services of mass media are not telecommunication services.";

d) the thirtieth to state the paragraph in the following edition:

"Services of electric communication (telecommunication service) - services in acceptance and transmission of messages of telecommunication, including distribution TV, radio channels which are offered one or several legal entities or physical person. Services of telecommunication do not include service of mass media.";

e) add Article with paragraphs the forty ninth - sixty third the following content:

"Broadcasting multiplex - set of teleradio channels, and also the additional information included in structure of these teleradio channels united in the digital packet transferred on networks of telecommunication on one broadcast channel.

Broadcast channel - set technical and the software intended for land radio distribution of one analog television channel or broadcasting multiplex equivalent to it digital TV, radio channels on the territory determined by parameters of these means. The broadcast channel is provided with necessary radio-frequency range.

Conversion of radio-frequency range - set of the economic, organizational and technical actions directed to expansion of use of radio-frequency range by radio-electronic means of civil appointment.

The national table of distribution of radio frequencies - the document which establishes distribution of strips of radio frequencies between radio services and conditions of their use and also categories of strips of radio frequencies are determined.

The operator of TV and radio broadcasting - the operator of telecommunication having the corresponding license in the field of telecommunication and/or data transmission in licensed requirements to which distribution TV, radio channels is included.

Strip of radio frequencies - the area of radio frequencies limited lower and upper to limits.

The user - the physical person or legal entity using telecommunication services irrespective of whether it is subscriber or not.

Radio service - organizational and technical set of the radio-electronic and other technical means providing the radiation, transfer and (or) acceptance of radio waves for particular purposes of telecommunication.

Radio amateur service - radio service for the purposes of self-training, negotiation communication and technical researches performed by fans, that is the persons having on this due permission and who are engaged in radio engineering only from private interest without extraction of material benefit.

Radio amateur satellite service - the radio service using the space stations established on satellites of Earth for the same purposes as radio amateur service.

Radio frequency - the frequency of electromagnetic oscillations established for designation of single component of radio-frequency range.

Radio-electronic means - the technical means intended for transfer and/or acceptance of radio waves, consisting of one or several transferring and/or intakes or combination of such devices and including the service equipment.

Distribution TV, radio channels - bringing to the consumer of electric signal TV, radio channels with use of technical means of telecommunications irrespective of the applied technologies operators of TV and radio broadcasting.

Forming of electric signal TV, radio channels - transformation of programs of teleradio channels to the electric signal intended for distribution on networks of telecommunication irrespective of the applied technologies.

Frequency assignment - the permission issued by authorized state body on communication on the right of operation of radio-electronic means and/or high-frequency devices with use of strips and/or nominals of the radio frequencies or radio channels under certain conditions providing electromagnetic compatibility.";

Part 2 of Article 4 to add 2) with paragraphs the sixth or fourteenth the following content:

"-approval of rules of carrying out conversion of radio-frequency range;

- approval of technique of the feasibility statement on costs for carrying out conversion of radio-frequency range;

- approval of requirements to networks of telecommunications of the operator of long distance and/or international telecommunication;

- approval of the National table of distribution of radio frequencies between radio services of the Kyrgyz Republic;

- approval of national system and plan of numbering of the Kyrgyz Republic;

- approval of procedure for preparation and use of networks of telecommunications public, resources of single network of telecommunications for needs of state bodies, bodies of defense, safety and protection of law and order of the Kyrgyz Republic;
