Approve the enclosed changes which are made to acts of the Government of the Russian Federation concerning the conclusion of agreements of power supply (purchase and sale (delivery) of electrical energy (capacity) before completion of the procedure of technological connection of power receiving devices of consumers of electrical energy.

Changes which are made to acts of the Government of the Russian Federation concerning the conclusion of agreements of power supply (purchase and sale (delivery) of electrical energy (capacity) before completion of the procedure of technological connection of power receiving devices of consumers of electrical energy

1. In Rules of technological connection of power receiving devices of consumers of electrical energy, facilities for production of electrical energy, and also the objects of electric grid economy belonging to the network organizations and other persons, to power networks, approved by the order of the Government of the Russian Federation of  December 27, 2004 No. 861 "About approval of Rules of non-discriminatory access to services in transfer of electrical energy and rendering these services, Rules of non-discriminatory access to services in supervisory control in power industry and rendering these services, Rules of non-discriminatory access to services of Trading System Administrator of the wholesale market and rendering these services and Rules of technological connection of power receiving devices of consumers of electrical energy, facilities for production of electrical energy, and also the objects of electric grid economy belonging to the network organizations and other persons to power networks" (Russian Federation Code, 2004, No. 52, Art. 5525; 2009, No. 17, Art. 2088; 2010, No. 40, Art. 5086; 2012, No. 23, Art. 3008; 2013, No. 42, Art. 5373; 2014, No. 7, Art. 689; No. 9, Art. 913; 2015, No. 12, Art. 1755; No. 25, Art. 3669; 2016, No. 9, Art. 1266; No. 49, Art. 6928):

a) in Item 9:

the fourteenth to state the paragraph in the following edition:

"In case of availability at the applicant of the agreement providing sale of electrical energy (capacity) in the retail market within which the applicant supposes implementation of power supply of power receiving devices concerning which the application is submitted in the request the name of the subject of the retail market, number and date of the specified agreement are specified.";

the fifteenth to declare the paragraph invalid;

add with paragraphs of the following content:

"Concerning applicants whose maximum capacity of power receiving devices makes over 670 kW the data provided by the subitem "l" of this Item are specified at the request of the applicant in case of intention to provide documents for the conclusion of the agreement providing sale of electrical energy (capacity) in the retail market through the network organization before completion of the procedure of technological connection of power receiving devices of the applicant to objects of electric grid economy of this organization.

At the same time if the applicant which maximum capacity of power receiving devices makes over 670 kW in the request does not specify the data provided by the subitem "l" of this Item, provision of these rules and Basic provisions of functioning of the retail markets of electrical energy, regulating order of interaction of the network organizations guaranteeing suppliers (the power sales organizations) and applicants in the course of technological connection of power receiving devices are applied in the part which is not regulating question of the conclusion of the agreement providing sale of electrical energy (capacity) in the retail market before completion of actions for technological connection of power receiving devices of applicants.";

b) declare Item 9.1 invalid;

c) in Item 10:

 state the subitem "d" in the following edition:

"e) for legal entities - the extract from the Unified State Register of Legal Entities, for individual entrepreneurs - the extract from the Unified State Register of Legal Entities and Individual Entrepreneurs, and also the power of attorney or other documents confirming powers of the representative of the applicant filing and receiving documents if the application is submitted to the network organization by the applicant's representative, the passport copy of the citizen of the Russian Federation or other identity document if the individual entrepreneur or the citizen acts as the applicant;";

 state the subitem "i" in the following edition:

"i) the draft agreement of power supply signed by the applicant (purchase and sale (delivery) of electrical energy (capacity) or the protocol of disagreements to the draft agreement which form is placed it (is published) by the guaranteeing supplier according to Item 33 of Basic provisions of functioning of the retail markets of electrical energy (it is provided at the request of the applicant in case of intention to sign the agreement of power supply (purchase and sale (delivery) of electrical energy (capacity) with the guaranteeing supplier).";

d) in Item 15.1:

 shall be replaced with words words of "stipulated in Item 34 Basic provisions of functioning of the retail markets of electrical energy" "stipulated in Item 10 these rules";

add with words ", and also the copy of the request about technological connection of the corresponding power receiving devices in which the guaranteeing supplier or the power sales (power supplying) organization as subject of the retail market with which the applicant intends to sign the relevant agreement is specified";

e) in Item 19.1:

word in paragraph one" (in case of specifying by the applicant of data according to the subitem "l" of Item 9 of these rules)" to exclude;

third to state the paragraph in the following edition:

"If the draft agreement of power supply signed by the applicant is not attached to the request (purchase and sale (delivery) of electrical energy (capacity), drawn up according to the form of the agreement posted on the official site of the guaranteeing supplier or the protocol of disagreements to the agreement, the applicant who received the act of implementation of technological accession from the network organization in case of its return of the network organization after signing has in return the right to attach to it the agreement which is properly drawn up and signed in return providing sale of electrical energy (capacity) in the retail market earlier properly drawn up and signed from the guaranteeing supplier. Lack of the agreement providing sale of electrical energy (capacity) in the retail market is not the basis for failure to carry out by the network organization of the obligations provided by these rules regarding observance of the procedure of technological accession.";

e) in Item 67 of the word" (on condition of specifying by the applicant in the request of data according to the subitem "l" of Item 9 of these rules)" to exclude;

g) in Item 88:

the fourth to state the paragraph in the following edition:

"The network organization together with the act of accomplishment of specifications shall provide to the applicant earlier received from the guaranteeing supplier:";

word in paragraph seven", the data which specified in the request according to the subitem "l" of Item 9 of these rules," to exclude;

word in paragraph eight", specified in the request of the data according to the subitem "l" of Item 9 of these rules," to exclude;

2. In Basic provisions of functioning of the retail markets of electrical energy approved by the order of the Government of the Russian Federation of  May 4, 2012 No. 442 "About  functioning of the retail markets of electrical energy, complete and (or) partial restriction of the mode of consumption of electrical energy" (The Russian Federation Code, 2012, No. 23, Art. 3008; 2013, No. 1, Art. 68; 2014, No. 7, Art. 689; 2015, No. 5, Art. 827; 2016, No. 51, Art. 7372):

a) in paragraph four of Item 28 of the word "the directions to the guaranteeing supplier of documents (part of documents), stipulated in Item 34 this documents, and" to exclude;

b) in paragraph four of Item 29 of the word "the directions to the guaranteeing supplier of documents (part of documents), stipulated in Item 34 this documents, and" to exclude;

c) in Item 34:

in paragraph one of the word "directly, and in case of the conclusion of the agreement before completion of the procedure of technological connection of power receiving devices to objects of electric grid economy of the network organization concerning which the agreement is signed-it is direct or through the network organization" to exclude;

in paragraph six of the word "or in case of the direction of the documents provided by this Item for the conclusion of the relevant agreement before completion of the procedure of technological connection of power receiving devices of the consumer" to exclude;

to state the paragraph of the seventh in the following edition:

"documents on the admission in operation of metering devices (are provided in the presence at the applicant of metering devices);";

to state the paragraph of the eighth in the following edition:

"the document confirming availability of technological and (or) emergency armor (it is provided in case of its availability at the applicant);";

paragraphs the eleventh and twelfth to recognize invalid;

d) in paragraph one of Item 39.1 of the word " Item 34 of this document" shall be replaced with words " Item 10 of Rules of technological connection of power receiving devices of consumers of electrical energy, facilities for production of electrical energy, and also the objects of electric grid economy belonging to the network organizations and other persons to power networks".
