The government of Ukraine and the Government of the Republic of Belarus which are referred to as further with the Parties

based on the Contract between the Belarusian Soviet Socialist Republic and the Ukrainian Soviet Socialist Republic signed on December 20, 1990

aiming at development of trade and economic cooperation between Ukraine and the Republic of Belarus based on equality and mutual advantage,

proceeding from the sovereign right of each state to pursue independent external economic policy,

intending to promote growth of economic activity, ensuring full employment, performance improvement and rational use of resources,

aiming to promote harmonious development and growth of world trade, removal of obstacles on the way of its development,

agreed as follows:

Article 1

1. The parties do not apply the duty, taxes and fees having equivalent action for export and/or commodity import which come out customs area of one of the states and are intended for customs area of other state. Exceptions from this trade regime according to the approved nomenclature of goods are drawn up by the separate Protocol or the Agreement which is integral part of this Agreement.

2. For the purpose of this Agreement and for its action as goods which leave from the territories of both states are considered:

a) completely made in the territory of the country, or

b) being subject to processing and the territory of the country with use of raw materials, materials and components which leave the third countries and, changed with respect thereto accessory on classification of the harmonized system of the description and the coding of goods at least on one of the six first signs;

c) made with use noted in the item) raw materials, materials and components provided that their aggregate value does not exaggerate the fixed part of export price of goods which are implemented.

Detailed rules of exit of goods will be approved by the Parties in the separate document that will be integral part of this Agreement.
