About entering of amendment into the Section II of the Constitution of the Republic of Moldova

The Section II of the Constitution of the Republic of Moldova accepted on July 29, 1994 (repeated publication: 2016, No. 78, the Art. 140), with subsequent changes and amendments to add the official monitor of the Republic of Moldova with Chapter III-1 of the following content:
"Chapter III-1. National lawyer
Article 59-1. Status and role of the national lawyer
(1) the National lawyer provides promotion and protection of basic rights and human freedoms.
(2) the National lawyer can be the nominated person which has faultless reputation, high professional competence and it is known activities in the field of protection and promotion of human rights.
(3) the National lawyer is appointed by Parliament on the basis of the transparent procedure of selection provided by the law, by a majority vote the elected deputies, to the seven-year term which cannot be resumed. During the term of office the national lawyer is independent and impartial. To the national lawyer any imperative or representative mandate is inapplicable.
(4) the National lawyer does not bear legal responsibility for the views expressed when implementing powers.
(5) the Position of the national lawyer is incompatible with any other paid position, except for teaching, scientific or creative activities. The national lawyer has no right to be engaged in political activities and cannot be the member of any political party.
(6) Intervention in activities of the national lawyer, intended ignoring of its addresses and recommendations, and also preventing in any form of its activities attract legal responsibility according to the law.
(7) the National lawyer can be recalled from position by two thirds of voices of the elected deputies with observance of the procedure established by the law providing its preliminary hearing.
(8) the Procedure for the organization and activities of institute of the national lawyer is established by the organic law.".
