About introduction of amendments to some acts of the Government of the Russian Federation concerning introduction of complete and (or) partial restriction of the mode of consumption of electrical energy, and also application of seals of economic societies

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation concerning introduction of complete and (or) partial restriction of the mode of consumption of electrical energy, and also application of seals of economic societies.

2. Determine that the guaranteeing suppliers, the power sales (power supplying) organizations, electric power producers (capacities) in the retail markets of electrical energy and the network organizations within 20 days after day of entry into force of this resolution post on the official sites on the Internet:

information on the subscriber numbers allocated with the operator of mobile radiotelephone communication and (or) on the e-mail addresses intended for the direction to the consumer of electrical energy (capacity), the consumer of services in transfer to electrical energy of notifications on introduction of restriction of the mode of consumption of electrical energy;

information on obligation of consumers whose restriction of the mode of consumption of electrical energy can lead to economic, ecological or social effects, have the approved actions plan on ensuring readiness for introduction concerning their power receiving devices and (or) power generation facilities of complete restriction of the mode of consumption of electrical energy;

information on the responsibility established by the legislation of the Russian Federation for violation of procedure for complete and (or) partial restriction of the mode of consumption of electrical energy.

3. This resolution becomes effective after 120 days after day of its official publication.

Changes which are made to acts of the Government of the Russian Federation concerning introduction of complete and (or) partial restriction of the mode of consumption of electrical energy, and also application of seals of economic societies

1. Item 24 of the order of the Government of the Russian Federation of April 15, 1998 No. 392 "About economic operating conditions of agro-industrial complex of the Russian Federation in 1998" (The Russian Federation Code, 1998, No. 16, Art. 1858; No. 24, Art. 2736; 37, the Art. 4636) to declare No. invalid.

2. Item 5 of the order of the Government of the Russian Federation of January 7, 1999 No. 23 "About urgent measures for increase in overall performance of the hothouse companies in 1999" (The Russian Federation Code, 1999, No. 3, Art. 337; 50, the Art. 6239) to declare No. invalid.

3. In the order of the Government of the Russian Federation of May 29, 2002 No. 364 "About providing steady gazo-and power supply of the organizations financed by the means of the federal budget ensuring safety of the state" (The Russian Federation Code, 2002, No. 23, the Art. 2171):

a) in Item 1:

"electric and" to exclude words;

to replace the word of "power supply" with the word "heat supplies";

"power supplying" to replace the word with the word "heatsupplying";

b) declare item 4 invalid;

c) in appendix No. 3 to the specified resolution:

in the name:

"electric and" to exclude words;

a) add Item 11 with the subitem "n" of the following content:

"m) about the subscriber numbers allocated with the operator of mobile radiotelephone communication and (or) about the e-mail addresses intended for the direction to the consumer of electrical energy (capacity), the consumer of services in transfer to electrical energy of the notification on introduction of complete and (or) partial restriction of the mode of consumption of electrical energy.";

b) to add Item 12 after the paragraph of the sixth with the paragraph of the following content:

"Information specified in the subitem "n" of Item 11 of this document is subject to placement on the official site of the network organization in Internet network.";

c) add the Section IV with Item 17 (3) the following content:

"17(3). The producers which are subjects of the retail markets of electrical energy open information on the subscriber numbers allocated with the operator of mobile radiotelephone communication and (or) on the e-mail addresses intended for the direction to the consumer of electrical energy (capacity) of the notification on introduction of complete and (or) partial restriction of the mode of consumption of electrical energy by placement of the specified information on the official sites in Internet network.";

d) add Item 20 with the subitem "l" of the following content:

"k) information on the subscriber numbers allocated with the operator of mobile radiotelephone communication and (or) on the e-mail addresses intended for the direction to the consumer of electrical energy (capacity) of the notification on introduction of complete and (or) partial restriction of the mode of consumption of electrical energy.";

e) add Item 21 with the paragraph of the following content:

"Information specified in the subitem "l" of Item 20 of this document is subject to placement on the official sites of the guaranteeing suppliers who are power supplying and the power sales organizations in Internet network.".

6. In Rules of non-discriminatory access to services in transfer of electrical energy and rendering these services approved by the order of the Government of the Russian Federation of December 27, 2004 No. 861 "About approval of Rules of non-discriminatory access to services in transfer of electrical energy and rendering these services, Rules of non-discriminatory access to services in supervisory control in power industry and rendering these services, Rules of non-discriminatory access to services of Trading System Administrator of the wholesale market and rendering these services and Rules of technological connection of power receiving devices of consumers of electrical energy, facilities for production of electrical energy, and also the objects of electric grid economy belonging to the network organizations and other persons to power networks" (The Russian Federation Code, 2004, No. 52, Art. 5525; 2012, No. 23, Art. 3008):

a) add with Item 13 (3) the following content:

"13(3). In the contract with the consumer of services in transfer of electrical energy (except for consumers of services - the guaranteeing suppliers (the power sales, power supplying organizations), the network organizations and subjects of the wholesale market of electrical energy performing export (import) of electrical energy) except information, stipulated in Item 13 these rules, the subscriber number allocated with the operator of mobile radiotelephone communication and the e-mail address of such consumer of services intended for the direction to it of the notification on introduction of complete and (or) partial restriction of the mode of consumption of electrical energy shall be specified.";

b) state Item 29 in the following edition:

"29. The network organization according to the procedure and on the bases which are specified in Rules of complete and (or) partial restriction of the mode of consumption of electrical energy introduces complete and (or) partial restriction of the mode of consumption of electrical energy on the consumer of electrical energy (capacity).

The network organization has the right to initiate in connection with approach of the circumstances determined by Rules of complete and (or) partial restriction of the mode of consumption of electrical energy, introduction of complete and (or) partial restriction of the mode of consumption of electrical energy on the consumer of electrical energy (capacity).

Introduction of complete and (or) partial restriction of the mode of consumption of electrical energy on the consumer of electrical energy (capacity) does not involve agreement cancelation of rendering services in transfer of electrical energy and does not exempt such consumer of electrical energy (capacity) from obligation to pay the network organization in complete size the cost of the rendered services, and also from responsibility for improper execution by the consumer of electrical energy (capacity) of the obligations for such agreement.";

c) state Item 50 in the following edition:

"50. The amount of the actual losses of electrical energy in power networks is determined as difference between amount of the electrical energy transferred to power network from other networks or from electric power producers and amount of electrical energy which is delivered under agreements of power supply (purchase and sale (delivery) of electrical energy (capacity) and is consumed by the power receiving devices attached to this power network and also amount of electrical energy which is transferred to power networks of other network organizations.".

a) in Basic provisions of functioning of the retail markets of electrical energy approved by the specified resolution:

the thirteenth Item 2 to add the paragraph with words ", and also consumption of electrical energy during suspension of delivery of electrical energy under the agreement providing sale of electrical energy (capacity) in the retail markets in connection with introduction of complete restriction of the mode of consumption of electrical energy in the cases provided by the Rules of complete and (or) partial restriction of the mode of consumption of electrical energy approved by the order of the Government of the Russian Federation of May 4, 2012 No. 442 "About functioning of the retail markets of electrical energy, complete and (or) partial restriction of the mode of consumption of electrical energy";

the tenth Item 9 after words "seal of the guaranteeing supplier" to add the paragraph with words "(in the presence of seal)";

to state the paragraph of the seventh of Item 15 in the following edition:

"non-execution or improper execution by the power sales (power supplying) organization, the contractor of utilities of obligations on payment of electrical energy (capacity) in the retail market and (or) services in transfer of electrical energy if such non-execution or improper execution attracts in accordance with the terms of the agreement refusal unilaterally of the guaranteeing supplier and (or) the network organization from agreement performance completely. The organization before which are not performed or inadequate image obligations are fulfilled, notifies authorized body of the subject of the Russian Federation on approach of the specified event by the direction of the documents confirming non-execution or improper execution by the power sales (power supplying) organization, the contractor of utilities of obligations on payment of electrical energy (capacity) and (or) services in transfer of electrical energy (settlement reconciliation statements and (or) the judgments which took legal effect), with the method allowing to confirm receipt of the specified notification;";

in paragraph three of Item 17 of the word "the power sales (power supplying) organization for which" shall be replaced with words "the power sales (power supplying) organization or the contractor of utilities, for which";

in paragraph one of Item 19 of the word "The Power Sales (Power Supplying) Organization, for Which" shall be replaced with words "the Power sales (power supplying) organization or the contractor of utilities for which";

in Item 26:

in paragraph five:

after the words "takes measures on" to add with words "to reducing level or";

add Item 40 with the paragraph of the following content:

"In the purchase and sale agreement (delivery) of electrical energy (capacity) also shall be specified the subscriber number allocated with the operator of mobile radiotelephone communication (further - number of the mobile phone) and the e-mail address of the consumer, notifications on introduction of restriction of the mode of consumption of electrical energy intended for the direction to it.";
