1. The regulations on the agreement of purchases of goods and services for the state customers (further - provision) are developed based on the Law on purchases of goods, works and services for the state needs of N1166-XIII of 30.04.97, the Law on the budget, the Provision of the Government of the Republic of Moldova by N595 of 25.06.99, other legal acts concerning public procurements for the purpose of providing the state customers with single methodology of the conclusion of agreements as a result of carrying out public procurements.

2. When purchasing goods and services at the expense of public funds of the requirement of this provision are applied by the state customers without fail.

II. Concepts and determinations

In the text of this provision the following concepts are used:

1. The state customer - public authority, the organization, the economic agent who conducts procurement of goods and services through public funds.

2. The Ofertant - any physical person or legal entity representing the offer in the course of the procedure of purchases.

3. The supplier - the won ofertant who acquired the right to the conclusion of the delivery agreement of goods, rendering services with the state customer.

4. The consultant - the physical person or legal entity, the design institute or the economic agent rendering consulting services hired by the state customer and authorized to represent it when implementing public procurement.

5. The delivery schedule of goods (rendering services) - the document in which exact and specific information on terms and stages of agreement performance is given.

6. Guarantee of full implementation of the agreement - guarantee on accomplishment of contractual commitments by the supplier before the state customer which can be provided in the form of the bank guarantee and other forms similar to it.
