About modification of some legal acts of Ukraine concerning strengthening of protection of the right of the child to proper maintenance by enhancement of procedure for collection of the alimony

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Family code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2002, Art. No. 21-22, 135):

Part the second articles 70 after the words "if one of them did not care for material security of family" to add 1) with the words "evaded from participation in content of child(children)";

The text of Article 179 to state 2) in the following edition:

"1. The alimony received on the child is property of the child.

2. That from parents or other legal representatives of the child addressed to whom the alimony is paid disposes of the alimony only on purpose for the benefit of the child.

The minor child has the right to take part in the order the alimony received on its content.

3. The minor child has the right to independent receipt of the alimony and the order them according to the Civil code of Ukraine";

Part third of Article 181 to state 3) in the following edition:

"3. By a court decision funds for content of the child (alimony) are awarded in share from the income of his mother, the father or in firm sum of money at the choice of the parent or other legal representatives of the child together with whom the child lives.

The method of collection of the alimony determined by the judgment changes by a court decision in the claim of the receiver of the alimony";

4) in Article 182:

add part one with Items 3-1 and 3-2 of the following content:

"3-1) availability of personal and real estate, money;

3-2) expenses of the payer of the alimony, including for acquisition of real or personal estate which amount exceeds the tenfold size of subsistence minimum for able-bodied person are finished by the claimant of the alimony if the payer of the alimony does not prove source of origin of means";
