About modification of some legal acts of Ukraine concerning elimination of barriers to attraction of foreign investments

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. Paragraph one of article 204 of the Code of Ukraine about administrative offenses (1984, Appendix to No. 51, by the station 1122) after the words "operate on the territory of Ukraine" to add sheets of the Supreme Council of USSR with words "physical persons - the entrepreneurs using wage labor".

2. In the Law of Ukraine "About legal status of foreigners and stateless persons" (Sheets of the Verkhovna Rada of Ukraine, 2012, No. 19-20, of Art. 179 with subsequent changes):

1) in Article 4:

a) after part eleven to add with new part of the following content:

"12. The foreigners and stateless persons which are founders and/or participants and/or beneficial owners (controllers) of the legal entity registered in Ukraine also arrived to Ukraine for the purpose of control of activities of such legal entities and received the residence permit, are considered such which on legal causes are in the territory of Ukraine for action of type.

The basis for issue of the residence permit in the case provided by this part is the following:

1) the foreigner and the stateless person is founder and/or the participant, and/or the beneficial owner (controller) of the legal entity, data on whom are entered in the Unified State Register of Legal Entities, physical persons of entrepreneurs and public forming;

2) the size of ownership ratio of the foreigner or stateless person, or foreign legal entity, the beneficiary (controller) of which he is, in the authorized capital of the Ukrainian legal entity constitutes at least 100 000 euros on the official exchange rate established by the National Bank of Ukraine for date of introduction of foreign investment".
