About modification of the Code of civil procedure of the Kyrgyz Republic

Article 1. Bring in the Code of civil procedure of the Kyrgyz Republic (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2017, No. 1 (2), the Art. 14) the following changes:

1) in Article 211:

a) shall be replaced with words the words "Judgment" "1. Judgment";

b) add Article with part 2 following of content:

"2. Take legal effect from the moment of announcement the decisions passed by courts according to statements for recognition extremist or terrorist information materials which are called for implementation of such activities or prove or justify need of its implementation.";

Subsection 3 to add 2) with Chapter 25-1 of the following content:

"Chapter 25-1. Production according to statements for recognition extremist or terrorist information materials which are called for implementation of such activities or is proved or justify need of its implementation

Article 261-1. Filing of application

1. The prosecutor, within the competence having the right to file the petition about recognition extremist or terrorist information materials which are called for implementation of such activities or prove or justify need of its implementation, in the place of their detection, distribution or finding of the organization which performed production of such materials with observance of rules about the cognizance established by Chapter 4 of this Code.

2. According to the statement of the prosecutor the court has the right to limit temporarily access to information materials before decision according to the procedure, provided by Chapter 14 of this Code.

Article 261-2. Consideration of the application

1. The application shall be considered by court in three-day time from the moment of its receipt. In cases if the facts containing in the statement require additional check, decisions on them are made not later than in five-day time.
