About modification of the Budget code of Ukraine concerning enhancement of the mechanism of financial provision of the treatment of radioactive waste

The Verkhovna Rada of Ukraine decides:

I. Bring in the Budget code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2010, Art. No. 50-51, 572) the following changes:

1. Add with Article 24-3 of the following content:

"Article 24-3. State fund of the treatment of radioactive waste

1. The state fund of the treatment of radioactive waste is created as a part of special fund of the Government budget of Ukraine.

2. Sources of forming of the State fund of the treatment of radioactive waste are:

1) the receipts determined by Item 7-4 of part three of article 29 of this Code;

2) other receipts, stipulated by the legislation.

3. Means of the State fund of the treatment of radioactive waste are aimed at financial provision of budget programs within which works on designing, construction, commissioning, operation, removal from operation or closing of the objects intended for the treatment of radioactive waste which is transferred by licensees to the possession of the state including storages for long-term storage / burial of the radioactive waste formed after conversion of the fulfilled nuclear fuel of the Ukrainian nuclear power plants are performed and other actions connected with the treatment of radioactive waste which is transferred by licensees to the possession of the state are performed.

4. The procedure for use of means of the State fund of the treatment of radioactive waste is established by the Cabinet of Ministers of Ukraine".

2. In Article 29:

Shall be replaced with words 1) in Item 16-1 of part two of the word "in the general fund" "in special fund";

Part third to add 2) with Item 7-4 of the following content:

"7-4) ecological tax which is levied for formation of radioactive waste (including already cumulative) and/or temporary storage of radioactive waste by their producers over the term established by special conditions of the license".

3. The fourth Article 30 to add part with Item 2-2 of the following content:
