About modification of article 4 of the Law of Ukraine "About the treatment of radioactive waste" concerning enhancement of funding mechanism for the treatment of radioactive waste

I. Article 4 of the Law of Ukraine "About the treatment of radioactive waste" (Sheets of the Verkhovna Rada of Ukraine, 1995, No. 27, Art. 198; 2008, No. 52, Art. 394; 2011, 23, 160, No. 29, the Art. 272) to state No. to the Art. in the following edition:

"Article 4. Financial provision of activities in the field of the treatment of radioactive waste

Expenses on financial provision of activities in the field of the treatment of radioactive waste are annually provided in the Government budget of Ukraine.

As a part of special fund of the Government budget of Ukraine the State fund of the treatment of radioactive waste is created (further - Fund).

The revenues of Fund are created at the expense of the means arriving from the ecological tax levied for formation of radioactive waste (including already cumulative) and/or temporary storage of radioactive waste by their producers over the term established by special conditions of the license, and also other receipts which are not prohibited by the legislation.

Fund is allocated for implementation of budget programs within which works are performed and actions for designing, construction, commissioning, operation, removal from operation or closing of the objects intended for the treatment of radioactive waste which is transferred by licensees to the possession of the state including storages for long-term storage or burial of the radioactive waste formed after conversion of the fulfilled nuclear fuel of the Ukrainian nuclear power plants are performed and other actions connected with the treatment of radioactive waste which is transferred by licensees to the possession of the state are performed. The direction of fund on implementation of such budget programs is performed on representation of Committee of the Verkhovna Rada of Ukraine concerning environmental policy, environmental management and mitigation of consequences of the Chernobyl catastrophic crash and to approval of Committee of the Verkhovna Rada of Ukraine concerning the budget.
