About modification of the order of the Government of the Kyrgyz Republic "About approval of the provisions regulating privatization of state-owned property" of March 26, 2003 No. 168

For the purpose of increase in efficiency of process of privatization of state-owned property, according to articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic", the Government of the Kyrgyz Republic decides:

1. Bring in the order of the Government of the Kyrgyz Republic "About approval of the provisions regulating privatization of state-owned property" of March 26, 2003 No. 168 the following changes:

in the Regulations on privatization of state-owned property by method of direct sale approved by the above-stated resolution:

- state Item 2 in the following edition:

"2. Direct sale is method of privatization of state-owned property to certain investor. Direct sale is applied in exceptional cases, in case of impossibility of sale of subject to privatization at least three times by any of the listed below methods:

- sale at auction;

- sale at tender;

- transfer to management with the subsequent redemption;

- transfer to lease with the subsequent redemption;

- introduction as contribution to the authorized capital of economic societies;

- placement and sale of shares on the stock exchange.";

"5. Can be subjects to privatization:

- shares (share in the authorized capital) of economic societies;

- the production and non-productive divisions of the state company constituting efficient complex, as property complex, created as a result of carrying out reorganization (liquidation) the state company;

- other state-owned property concerning which the industry legislation does not establish prohibition on privatization.";
