About application of the stimulating regulation in the field of transmission of electricity by the high-level and interstate power networks

According to article 4 of the Law of Ukraine "About natural monopolies" and to the Law of Ukraine "About the National commission performing state regulation in the field of power and utilities" to the order of the Cabinet of Ministers of Ukraine of May 27, 2016 "About approval of the plan of priority actions of the government for 2016" the National commission performing state regulation in spheres of power and utilities decides No. 418-r:

1. The stimulating regulation in the field of transmission of electricity by the high-level and interstate power networks is applied to the licensee on transfer of electrical energy by the high-level and interstate power networks (further - the licensee).

2. Condition for transition of the licensee to the stimulating regulation are:

1) evaluating assets according to the Technique of assessment of assets of subjects of natural monopolies, subjects of managing in the adjacent markets in the field of the combined production of the electrical and heat energy approved by the order of Fund of state-owned property of Ukraine of March 12, 2013 No. 293 (with changes) registered in the Ministry of Justice of Ukraine on March 29, 2013 for No. 522/23054, and availability of the positive review of the valuation report of assets constituted by the reviewer working in public authority, performing state regulation of estimative activities;

2) accomplishment of investing program in the year preceding transition to the stimulating regulation, to 95% at least (inclusive).

3. During the first regulatory period the licensee shall provide:

1) full implementation of the actions plan on ensuring accuracy of the data for monitoring of indicators of continuity of transfer of electrical energy (in particular, by creation of systems of registration of breaks in transfer of electrical energy);
