Chapter 1. General provisions

Article 1. Subject of regulation of this Federal Law

This Federal Law governs the relations arising during creation of the innovative scientific and technological centers and ensuring their functioning for the purpose of realization of priorities of scientific technology development of the Russian Federation, increase in investment appeal of the sphere of researches and developments, commercialization of their results, expansions of access for citizens and legal entities to participation in perspective, commercially attractive scientific and scientific and technical projects.

Article 2. The basic concepts used in this Federal Law

For the purpose of this Federal Law the following basic concepts are used:

1) the innovative scientific and technological center - set of the organizations which main objective of activities is implementation of scientific and technological activities, and other persons whose activities are aimed at providing functioning of such center, acting in the territory determined by the Government of the Russian Federation;

2) the project - set of the actions directed to goal achievement on creation and ensuring functioning of the innovative scientific and technological center;

3) the territory of the innovative scientific and technological center - set of the parcels of land with particular legal regime of implementation of activities in the areas established according to this Federal Law which are intended for project implementation and are included in borders of the territory of the innovative scientific and technological center according to the decision of the Government of the Russian Federation;

4) infrastructure of the innovative scientific and technological center - set of buildings, constructions and other objects, including objects of the utility, social, transport infrastructures which are in the territory of the innovative scientific and technological center;

5) the initiator of the project - the educational organization, the scientific organization which correspond to the criteria established by the Government of the Russian Federation or the national research center, at the initiative of which the innovative scientific and technological center is created if other is not provided by this Federal Law;

6) fund - the Russian non-profit organization which is created in form of business of fund for the purpose of project implementation and as which founders act the Russian Federation (on behalf of the Government of the Russian Federation) and (or) the initiator of the project, and (or) the subject of the Russian Federation (on behalf of the supreme executive body of the subject of the Russian Federation) in the territory of whom it is located or will be located the innovative scientific and technological center;

7) managing company - the Russian organization which is created in form of business of joint-stock company for the purpose of implementation of functions on management of the innovative scientific and technological center and founders (shareholders) of which act the Russian Federation (on behalf of the Government of the Russian Federation or on behalf of executive body of the federal territory Sirius), and (or) the initiator of the project, and (or) the subject of the Russian Federation (on behalf of the supreme executive body of the subject of the Russian Federation) in the territory of whom it is located or will be located the innovative scientific and technological center. Functions on management of several innovative scientific and technological centers can be assigned to one managing company. Functions of managing company in the federal territory Sirius have the right to perform body of the public power of the federal territory Sirius;

8) subsidiary of managing company - the economic society created by managing company only for the purpose of implementation according to this Federal Law of part of functions of managing company;

9) the project participant - the Russian legal entity whose main objective of activities is implementation of scientific and technological activities according to this Federal Law and who received project participant status according to this Federal Law;

10) scientific and technological activities - scientific (research), scientific and technical and innovative activities, accomplishment of researches and developments, implementation of scientific and (or) scientific and technical projects, use of the received scientific and (or) scientific and technical results, results of intellectual activities, including their commercialization, for the directions determined in the decision on creation of the innovative scientific and technological center according to priorities of scientific technology development of the Russian Federation;

11) person participating in project implementation, - fund, managing company, subsidiary of managing company, the initiator of the project, the project participant, the organization with participation of the state (including affiliated economic society of the organization with participation of the state), other legal entity, except for public authority, body of the public power of the federal territory Sirius, local government body, or the individual entrepreneur, performing project sales activity, including ensuring functioning of the innovative scientific and technological center by means of provision of goods, performance of works, rendering services in the territory of the innovative scientific and technological center, creation and (or) development of infrastructure of the innovative scientific and technological center, the organization giving the state support of innovative activities, created based on the Federal Law regulatory legal act of the President of the Russian Federation, regulatory legal act of the Government of the Russian Federation or regulatory legal act of executive body of the subject of the Russian Federation, body of the public power of the federal territory Sirius and performing development of infrastructure of the innovative scientific and technological center and (or) support of project participants;

12) rules of the project - single for all persons participating in project implementations, the activities procedure in the territory of the innovative scientific and technological center containing including set of the rights and obligations of persons participating in project implementation. Execution of the specified obligations is necessary condition of implementation of activities by persons participating in project implementation in the territory of the innovative scientific and technological center;

13) the organization with participation of the state - the Russian legal entity (except for public institution, the state unitary enterprise) whose founder are the Russian Federation and (or) the subject of the Russian Federation, and (or) in the authorized capital of which the share (contribution, the number of shares) of the Russian Federation and (or) the subject of the Russian Federation constitutes more than fifty percent and (or) concerning which the Russian Federation and (or) the subject of the Russian Federation have the right directly or indirectly to dispose more than fifty percent of total quantity of the voices falling on voting shares (shares) constituting the authorized capital of such legal entity, the strategic joint-stock company included in the list of the strategic companies and strategic joint-stock companies approved by the President of the Russian Federation, and also affiliated economic society such the legal entity or society in which such the legal entity or society has the right to dispose directly or indirectly more than fifty percent of total quantity of the voices falling on voting shares (shares) constituting the authorized capital of the specified affiliated economic society.

Article 3. Creation and termination of activities of the innovative scientific and technological center

1. For the purpose of creation of the innovative scientific and technological center the initiator of the project addresses in the federal executive body authorized by the Government of the Russian Federation with the offer on creation of the innovative scientific and technological center containing including:

1) the expected directions of scientific and technological activities which answer the purpose of creation of the innovative scientific and technological center determined by this Federal Law and which are planned to be performed in the territory of the innovative scientific and technological center;

2) the list of the parcels of land which are supposed to be included in borders of the territory of the innovative scientific and technological center, and the real estate units necessary for project implementation located on them, including including the list of the parcels of land and other real estate units which are subject to transfer to fund with indication of the right (property, lease) on which such transfer is supposed (including by means of introduction as property fee);

3) the offer on determination of the Russian non-profit organization as fund or the offer on creation of fund and candidates for the CEO of fund, the head and members of governing bodies of fund;

4) the offer on determination of the Russian organization as managing company or the offer on creation of managing company, and also the draft of the charter of managing company and the offer on candidates for heads and members of governing bodies of managing company (except for general shareholder meeting);

5) offers on comprehensive plan of development of the territory;

6) offers on contents of rules of the project.

1.1. By the government of the Russian Federation other requirements to contents of the offer on creation of the innovative scientific and technological center and other provided part 5.2 of this Article of information on creation of the innovative scientific and technological center can be established.

1.2. The government of the Russian Federation also establishes:

1) form of the offer on creation of the innovative scientific and technological center and other provided part 5.2 of this Article of information on creation of the innovative scientific and technological center;

2) selection criteria of offers on creation of the innovative scientific and technological center;

3) evaluation criteria other provided part 5.2 of this Article of information on creation of the innovative scientific and technological center;

4) criteria of efficiency of functioning of the innovative scientific and technological center.

1.3. Procedure for consideration of offers and other provided part 5.2 of this Article of information on creation of the innovative scientific and technological center, the procedure for selection of offers and assessment of the specified information, evaluation procedure of efficiency of functioning of the innovative scientific and technological center are established by the Government of the Russian Federation.

1.4. The initiator of the project in case of the direction of the offer on creation of the innovative scientific and technological center has the right to provide the offer on the list of the parcels of land and real estate units which are subject to transfer by fund to property of the organization with participation of the state in case of inclusion of the specified organization in the register of persons participating in project implementations, and agreement signatures between fund and the organization with participation of the state about creation of infrastructure facilities of the innovative scientific and technological center with appendix of the proving materials which list is determined by the Government of the Russian Federation.

2. The territory of the innovative scientific and technological center can be located in the territory of one or several subjects of the Russian Federation.

3. Inclusion in borders of the territory of the innovative scientific and technological center of the parcels of land on which state-owned property is not differentiated of the parcels of land which are in property of the subject of the Russian Federation or municipal property is allowed in coordination with the subject of the Russian Federation or the municipality.
