About modification and amendments in some legal acts
The Parliament adopts this organic law.
Art. I. – Article 44 of the Law on National Bank of Moldova No. 548/1995 (repeated publication: 2015, Art. No. 297-300, 544), with subsequent changes and amendments to add the official monitor of the Republic of Moldova with Item e) the following content:
"e) according to the powers to check during remote checks and/or spot tests accuracy of the information, provided by commercial banks to bureau of credit histories, and correctness of use of credit reports, including procedure for receipt of consent of subjects of credit stories to provision of information in bureau of credit histories and procedure for receipt of credit reports.".
Art. II. – In article 245-12 of the Criminal code of the Republic of Moldova No. 985/2002 (repeated publication: The official monitor of the Republic of Moldova, 2009, Art. No. 72-74, 195), with subsequent changes and amendments to make the following changes and addition:
in the name of Article of the word "in activities" shall be replaced with words "about activities";
part (to state 2) in the following edition:
"(2) Intentional non-presentation of information in the amount established by the law or intentional representation of unreliable information in bureau of credit histories sources of forming of credit stories, and also their officials if these actions cause damage in large sizes,
are punished by penalty in the amount of 850 to 2350 conventional units with deprivation or without deprivation of the right to hold certain positions or to be engaged in certain activities for a period of up to 5 years, and in case of the legal entity – penalty in the amount of 2000 to 4000 conventional units with deprivation of the right to be engaged in certain activities.";
