About modification and amendments in some legal acts

The Parliament adopts this organic law.

Art. I. – In the Tax code No. 1163/1997 (repeated publication: The official monitor of the Republic of Moldova, special release of February 8, 2007), with subsequent changes and amendments to make the following changes and additions:

1. Add Article 12 with Item 16) of the following content:

"16) Liquidating payments – the payments in cash and/or non-cash form transferred to participants/shareholders/members/founders in case of asset allocation of the liquidated subject after satisfaction of requirements of creditors;".

2. In Article 12-1:

part (to state 3) in the following edition:

"(3) For the business entity who made the decision on liquidation within calendar year, the tax period is considered:

a) the period from the beginning of calendar year before date of creation of the pro liquidation balance sheet;

b) the period from the beginning of calendar year before approval date of the final liquidation balance sheet.";

add Article with part (3-1) following of content:

"(For the reorganized companies tax period the period from the beginning of calendar year before date of exception of the company of the State register is considered 3-1).".

3. Add Article 24 with part (22) the following content:

"(22) the deduction of the expenses incurred by business entity in connection with its liquidation excepting the expenses/losses connected with asset revaluation, write-off of assets which cannot be liquidated and also write-off of debt obligations which cannot be compensated Is allowed.".

4. In part (Article 54 1/1 of the word "since the beginning of calendar year before day of exception of business entity of the State register." shall be replaced with words 3) ", established according to parts (3) and (3-1) Articles 121.".

6. In Article 90:
