About introduction of amendments to the order of the Minister of investments and development of the Republic of Kazakhstan of April 30, 2015 No. 531 "About approval of standards of the state services in the field of communication"

According to Item 1 of article 43-1 of the Law of the Republic of Kazakhstan of March 24, 1998 "About regulatory legal acts" I ORDER:

1. Bring in the order of the Minister of investments and development of the Republic of Kazakhstan of April 30, 2015 No. 531 "About approval of standards of the state services in the field of communication" (registered in the Register of state registration of regulatory legal acts for No. 11380, published on July 20, 2015 in information system of law of regulatory legal acts of the Republic of Kazakhstan of Ad_let) the following changes:

in the standard of the state service "Distribution of Resource of Numbering and Allocation of Numbers, and also Their Withdrawal" approved by the specified order:

1) of Item 3 to state the subitem in the following edition:

"1) The Government for Citizens State corporation (further - the State corporation);";

state item 4 in the following edition:

"4. Term of rendering the state service:

1) from the moment of delivery of document package in the State corporation, and also in case of the address on the portal - 20 (twenty) working days;

In case of the appeal to the State corporation day of acceptance does not enter rendering the state service in time.

2) the most allowed time of expectation for delivery of document package in the State corporation - 15 minutes;

3) the most allowed time of servicing of uslugopoluchatel in the State corporation - 20 minutes.";

for receipt of prefix of the choice of the operator of long distance and (or) international telecommunication in addition to the list of documents specified in the subitem 1) of this Item the list of the transit switching stations of network of the operator which are standard points of accession of networks for the purpose of the choice of operators of long distance and (or) international telecommunication in each region of presence of the operator is submitted;

for receipt of code of the H1kh2kh3kh4 operator providing communication services with use of code of access to service in again entered or in the service operating earlier in addition to the list of documents the following documents are submitted:

detailed description of service;

reasons for feasibility of the organization communication services;

the specific description of method of rendering offered communication services;

offers on tariffing and routing of challenges.

Logical customer addresses of the services "X4X5X6X7" are allocated with the telecom operator (provider of service) in case of the subscription of service;

for withdrawal of resource of numbering:

application on the withdrawal of resource of numbering of single network of telecommunications issued by uslugopoluchatel of the state service with indication of data on the order of the service provider on allocation of resource of numbering in form according to appendix 3 to this standard of the state service.

The employee of the State corporation receives data on identity documents, on state registration (re-registration) of the legal entity from the corresponding state information systems through lock of "the electronic government".

In case of documents acceptance the employee of the State corporation reproduces electronic copies of documents then returns these documents to uslugopoluchatel.

The employee of the State corporation receives the written consent of uslugopoluchatel to use of the data which are the secret protected by the law, containing in information systems when rendering the state services if other is not provided by the laws of the Republic of Kazakhstan;

2) on the portal:

for receipt of resource of numbering:

application on the allocation of resource of numbering of single network of telecommunications issued by uslugopoluchatel of the state service in form according to appendix 1 to this standard of the state service;

the explanatory note in form, according to appendix 2 to this standard of the state service;

detailed description of service;

reasons for feasibility of the organization communication services;

the specific description of method of rendering offered communication services;

offers on tariffing and routing of challenges.

The service provider receives data on identity documents, on state registration (re-registration) of the legal entity from the corresponding state information systems through lock of "the electronic government".

In the State corporation issue of result of the state service is performed based on the receipt on acceptance of the relevant documents, in case of presentation of the identity certificate (or his representative under the notarized power of attorney).

The state corporation provides storage of result within one month then transfers them to the service provider for further storage. In case of the appeal of uslugopoluchatel to the State corporation after one month, at the request of the State corporation the service provider within one working day sends ready documents to the State corporation for issue to uslugopoluchatel.

state Items 13 and 14 in the following edition:

"13. Uslugopoluchatelyam of the functions of organism having violation of health with permanent frustration limiting its life activity, in case of need documents acceptance, for rendering the state service, is made by the worker the State corporation with departure at the place of residence by means of the address through Edinny contact - the center 1414, 8 800 080 7777.

14. Addresses of places of rendering the state service are placed on:

1) Internet resource of the Ministry - www.mid.gov.kz;

2) Internet resource of the State corporation - www.con.gov.kz;

3) portal.";

2. To committee of communication, informatization and information of the Ministry for Investments and Development of the Republic of Kazakhstan (Kazangap T. B.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of the copy of this order in printing and electronic type on official publication in periodic printing editions and information system of law of Ad_let within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan, and also in the Republican center of legal information within ten calendar days from the date of receipt of the registered order for inclusion in reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after its first official publication, but not earlier than March 1, 2016.

Standard of the state service "Issue of Permission to Use of Radio-frequency Range of the Republic of Kazakhstan"

1. General provisions

1. The state service "Issue of Permission to Use of Radio-frequency Range of the Republic of Kazakhstan" (further - the state service).

2. The standard of the state service is developed by the Ministry for Investments and Development of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears Committee of communication, informatization and information of the Ministry (further - the service provider).

Reception of an application and issue of result of rendering the state service are performed through:

1) The Government for Citizens State corporation (further - the State corporation);

2) the web portal of "the electronic government" www.egov.kz (further - the portal).

2. Procedure for rendering the state service

4. Term of rendering the state service:

1) from the moment of delivery of document package in the State corporation, and also in case of the address on the portal - 27 (twenty seven) working days.

In case of need carrying out the international coordination term is prolonged no more than for four months.

The rate of payment is performed according to the Code of the Republic of Kazakhstan of December 10, 2008 "About taxes and other obligatory payments in the budget" (Tax code), according to appendix 2 to this standard of the state service.

Payment is performed in cash and non-cash forms through the banks of the second level and the organization performing separate types of banking activities.

In case of giving of electronic request for receipt of the state service through the portal, payment can is performed through payment gateway of "the electronic government" (further - PShEP).

8. Working schedule:

1) the State corporation - Monday through Saturday inclusive, according to the working schedule from 9:00 till 20:00 o'clock, without interruption for lunch except for days off and holidays, according to the labor law.

the completed questionnaire on RES on the corresponding type of radio communication in forms, according to appendices 4, 5, 6, 7, 8, 9, 10 to this standard of the state service (for ship stations the completed questionnaire with specifications in form, according to appendix 11 to this standard of the state service).

In case of documents acceptance the employee of the State corporation reproduces electronic copies of documents then returns these documents to uslugopoluchatel.

The service provider and the employee of the State corporation receives the consent of uslugopoluchatel to use of the data which are the secret protected by the law, containing in information systems when rendering the state services if other is not provided by the laws of the Republic of Kazakhstan.

In the State corporation issue of ready documents is performed based on the receipt on acceptance of the relevant documents, in case of presentation of the identity certificate (or his representative under notarially zavernny power of attorney).

The state corporation provides storage of results current of one month then transfers them to the service provider for further storage. In case of the address of uslugopoluchatel after one month, at the request of the State corporation the service provider within one working day makes request to the service provider. The service provider within one working day sends ready documents to the State corporation for issue to uslugopoluchatel;

In case of representation by uslugopoluchatel of incomplete document package according to the list, stipulated in Item 9 these standards of the state service, the employee of the State corporation refuses reception of an application and issues the receipt on refusal in documents acceptance in form, according to appendix 12 to this standard of the state service.

The basis for refusal in rendering the state service is:

1) discrepancy of the declared strip of frequencies, radio frequencies (the radio-frequency channel) to the national table of distribution of strips of frequencies;

2) discrepancy of parameters of radiation and acceptance of the declared radio-electronic means to requirements, regulations in the field of ensuring electromagnetic compatibility of radio-electronic means and high-frequency devices;

3) negative experimental testimony of electromagnetic compatibility with the radio-electronic means operating and planned for use;

4) employment civil users of the declared strip of frequencies, the radio frequencies (the radio-frequency channel) which are earlier appropriated to users according to the procedure, established by the legislation of the Republic of Kazakhstan;

5) absence of the corresponding license by sight business activity in the field of the communication with use of radio frequencies granted by the service provider according to the procedure, established by the legislation of the Republic of Kazakhstan;

6) negative results of carrying out approval of strip of frequencies, radio frequencies (the radio-frequency channel) with the central executive body of military management of the Republic of Kazakhstan;

7) the negative results of the procedure of the international coordination of radio frequency (the radio-frequency channel) if such procedure is provided by regulations of radio communication of International union of telecommunication and international treaties of the Republic of Kazakhstan.

3. Procedure for appeal of decisions, actions (bezdeystviye) of the service provider and (or) his officials, the State corporation and (or) his workers concerning rendering the state services

11. Appeal of decisions, actions (bezdeystviye) of the service provider and (or) his officials concerning rendering the state service: the claim is submitted addressed to the head of the service provider to the addresses placed on Internet resource of the Ministry: www.mid.gov.kz in the Section Committee of Communication, informatization and information (in the subsection "State Services"), or addressed to the head of the Ministry of the address: 010000, city of Astana, Prospekt Kabangbai of the batyr 32/1, e-mail address: mid@mid.gov.kz, phone (8-7172) 75-44-11.
