About introduction of amendments to the order of the Minister of health and social development of the Republic of Kazakhstan of January 22, 2015 No. 26 "About some questions of rehabilitation of disabled people"

According to subitem 9-1) of Item 1 of Article 7, Item 3 of Article 20 and Item 1 of article 22 of the Law of the Republic of Kazakhstan of April 13, 2005 "About social protection of disabled people in the Republic of Kazakhstan" I ORDER:

1. Bring in the order of the Minister of health and social development of the Republic of Kazakhstan of January 22, 2015 No. 26 "About some questions of rehabilitation of disabled people" (registered in the Register of state registration of regulatory legal acts for No. 10370, published in information system of law of Ad_let on March 26, 2015) the following changes:

Rules of provision of social services of the individual assistant for the disabled people of the first group having difficulty in movement and the specialist of sign language for hard of hearing persons - sixty hours a year according to the individual program of rehabilitation approved by the specified order to be reworded as follows according to appendix 1 to this order;

The rules of provision of sanatorium treatment to disabled people and handicapped children approved by the specified order to be reworded as follows according to appendix 2 to this order;

The rules of providing disabled people with the prosthetic and orthopedic help and technical supportive (compensatory) means approved by the specified order to be reworded as follows according to appendix 3 to this order;

The rules of providing disabled people with special vehicles approved by the specified order to be reworded as follows according to appendix 4 to this order.

2. To provide to social services department of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction in one copy of its copy in printing and electronic type in the state and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan, on official publication in periodic printing editions;

3) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan Zhakupova S. K.

4. This order becomes effective after ten calendar days after day of its first official publication, except for Chapters 3 of appendix 1 to this order, appendices 3 to this order which become effective since January 1, 2017 and Item 81 of appendix 3 to this order which becomes effective since January 1, 2015.

Rules of provision of social services of the individual assistant for the disabled people of the first group having difficulty in movement and the specialist of sign language for hard of hearing persons - sixty hours a year according to the individual program of rehabilitation

Chapter 1. General provisions

1. These rules of provision of social services of the individual assistant - sixty hours a year according to the individual program of rehabilitation (further - Rules) are developed for the disabled people of the first group having difficulty in movement and the specialist of sign language for hard of hearing persons according to the Law of the Republic of Kazakhstan of April 13, 2005 "About social protection of disabled people in the Republic of Kazakhstan" and determine procedure for provision of social services of the individual assistant for the disabled people of the first group having difficulty in movement (further - services of the individual assistant) and the specialist of sign language for hard of hearing persons - sixty hours a year (further - services of the specialist of sign language) according to the individual program of rehabilitation (further - the International Party of Russia).

2. In these rules the following basic concepts are used:

1) the individual assistant - the specialist rendering social services in escort of the disabled person from the place of residence to destination and back: for work, in educational institutions, and also in case of visit by the disabled person of local representative and executive bodies, court, prosecutor's office, objects of the social sphere, legal advice bureaus, the notary, cultural and spectacular actions, sports constructions, objects of trade, medical institutions, public service establishments and other organizations for the solution of the questions connected with training, employment, protection and realization of the rights and interests, receipt of information, execution of necessary documents, at terms of the contract;

2) the specialist of sign language - the specialist rendering the social services connected with provision of intermediary services between the hearing and not hearing people: rendering professional translation with sign and on sign language during participation of the disabled person in conferences, discussions and other public actions; in case of communication of the hard of hearing person with the hearing people for the solution of the questions connected with training, employment, protection and realization of the rights and interests, receipt of information in state bodies and the consulting organizations, execution of necessary documents.

3. Provision of services of the individual assistant, specialist of sign language is performed based on the International Party of Russia developed by territorial subdivision of authorized body in the field of social protection of the population taking into account medical indications and contraindications to provision of social services of the individual assistant and specialist of sign language according to appendix 1 to these rules.

Chapter 2. Procedure for provision of services of the individual assistant

4. For receipt of services of the individual assistant, the disabled people of the first group having difficulty in movement or their legal representatives or persons who received the power of attorney which is not requiring the notarial certificate from the disabled person (further - the applicant), submit to management of employment, work and social protection of the city of Astana, management of employment and social programs of the city of Almaty, city, district departments of employment and social programs for the residence (further - departments of employment) the statement on provision of means and services of rehabilitation according to social and professional part of the individual program of rehabilitation in form according to appendix 2 to these rules (further - the statement) and for identification - the document proving their identity.

5. Departments of employment in case of reception of an application create requests according to individual identification number of the disabled person in information systems of state bodies and (or) organizations through lock of "the electronic government" (further - information systems) for receipt of the following data:

1) about the identity document;

2) about registration on the permanent residence;

3) about disability establishment;

4) about developed actions in the International Party of Russia.

6. In the absence of data from information systems the following documents are enclosed to the application:

1) copy of the identity document of the disabled person;

2) the copy of the identity document of the legal representative or person who received the power of attorney - in case of filing of application by specified persons;

3) the document confirming registration on the permanent residence (the address reference or the reference of rural and/or aulny akims);

4) copy of the certificate of disability;

5) the copy of the statement from the International Party of Russia.

Documents are submitted in originals and copies for reconciliation then originals of documents return to the applicant.

7. The specialist of department of employment who adopted the statement checks completeness of document package, accepted at the applicant, provides compliance of electronic copies of documents to the originals provided by the applicant according to Item 6 of these rules.

8. The specialist of department of employment enters into the automated information system "E-social security" (further - AIS "E-social security") data from the statement, and also data on accomplishment or failure to carry out of the International Party of Russia.

9. In case of document package compliance, within ten working days from the date of their acceptance, departments of employment direct to the applicant the notification on document creation in any form (further - the notification) to provision of services of the individual assistant.

Departments of employment after issue of the notification quarterly of the 5th following reporting quarter constitute lists about the disabled people who are subject to providing services for the individual assistant and create the need for the specified services.

10. Departments of employment carry out purchase of services of the individual assistant according to the legislation of the Republic of Kazakhstan on the state social order and on public procurements, except for the services acquired at the physical persons which are not subjects of business activity according to services agreements.

11. Payment terms of services of the individual assistant, including expenses on journey and other, and also accounting of working hours, standard rates of servicing of disabled people and the list of the provided services make a reservation in the agreement.

12. Fee of the individual assistant is made by departments of employment, calculated on the basis of the size of the salary of the specialist in social work in hour according to wages system of civil servants, employees of the organizations containing at the expense of means of the government budget, employees of the state companies, but no more than 8 hours a day.

Chapter 3. Procedure for provision of services of the specialist of sign language

13. For receipt of services of the specialist of sign language, hard of hearing persons, or their legal representatives or persons who received the power of attorney which is not requiring the notarial certificate from the disabled person (further - the applicant), submit to departments of employment the application and for identification - the document proving their identity.

14. Departments of employment in case of reception of an application create requests according to individual identification number of the disabled person in information systems for receipt of the following data:

1) about the identity document;

2) about registration on the permanent residence;

3) about disability establishment;

4) about developed actions in the International Party of Russia.

15. In the absence of data from information systems the following documents are enclosed to the application:

1) copy of the identity document of the disabled person;

2) the copy of the identity document of the legal representative or person who received the power of attorney - in case of filing of application by specified persons;
