About step-by-step introduction of lease of textbooks in the general education organizations of the Kyrgyz Republic

For the purpose of creation of conditions for providing the general education organizations with textbooks, according to the Law of the Kyrgyz Republic "About education", articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve the Procedure for lease of textbooks in the general education organizations of the Kyrgyz Republic according to appendix.

2. To the Ministry of Education and Science of the Kyrgyz Republic:

- in two weeks to approve the schedule of step-by-step introduction of lease of textbooks in the general education organizations of the Kyrgyz Republic;

- determine the amount of the rent for use of the textbook for one academic year in the general education organizations of the Kyrgyz Republic;

- for the purpose of providing the general education organizations with textbooks together with the Ministry of Finance of the Kyrgyz Republic to make offers on creation and use of revolving fund of textbooks in Government office of the Kyrgyz Republic;

- carry out information and explanatory work among parents (legal representatives) of pupils of the general education organizations for step-by-step introduction of lease of textbooks.

3. To impose control of execution of this resolution on department of education, culture and sport of Government office of the Kyrgyz Republic.

4. This resolution becomes effective after seven days from the date of official publication.

Procedure for lease of textbooks in the general education organizations of the Kyrgyz Republic

1. General provisions

1. This Procedure for lease of textbooks in the general education organizations of the Kyrgyz Republic (further - the Procedure) establishes rules of issue in lease of textbooks by the pupil of 5-11 classes of the general education organizations and collection of the rent for use of textbooks of library stock of the general education organizations for the purpose of providing pupils with textbooks.

2. In this Procedure the following concepts are used:

- textbooks - the books for use by pupils of the general education organizations conforming to the state educational standards and recommended by the Ministry of Education and Science of the Kyrgyz Republic for use in educational process;

- lease of textbooks - issue in temporary use of textbooks from library stock of the general education organization by the pupil of 5-11 classes for a period of one academic year on paid basis;

- the rent - payment for use of the textbook within one academic year which amount is annually established by the Ministry of Education and Science of the Kyrgyz Republic according to technique of forming of the amount of the rent approved by the Ministry of Education and Science of the Kyrgyz Republic in coordination with antimonopoly authority;

- Organization of "Zhanna Kitep" of the Ministry of Education and Science of the Kyrgyz Republic (further - Organization) - the non-profit organization founded by the Ministry of Education and Science of the Kyrgyz Republic and functioning for the purpose of improvement of security of the general education organizations of the Kyrgyz Republic by textbooks, the timely edition of new textbooks, performing the activities on the principles of self-financing;

- settlement accounts of organization of "Zhanna Kitep" of the Ministry of Education and Science of the Kyrgyz Republic - settlement accounts of Organization of "Zhanna Kitep" of the Ministry of Education and Science of the Kyrgyz Republic in the servicing banks for accumulation of the money which arrived in the form of the rent for use of textbooks;

- the servicing bank - the commercial bank which is selected on the basis of open tender for servicing of Organization of "Zhanna Kitep" of the Ministry of Education and Science of the Kyrgyz Republic on the means arriving from the rent;

- term deposit - the cash amount placed by Organization of "Zhanna Kitep" of the Ministry of Education and Science of the Kyrgyz Republic on storage to the servicing bank for certain term which is used only on updating of textbooks of library stock of the general education organizations.

2. Procedure for issue of textbooks in lease

3. The list of the textbooks issued in lease annually affirms the Ministry of Education and Science of the Kyrgyz Republic (further - the Ministry).

4. Accounting, issue and return of textbooks from library stock of the general education organization are performed by the manager of library (librarian) of the general education organization. In case of absence in the state of position of the librarian are assigned by the order of the head of the general education organization of function of the librarian to one of teachers of the general education organization.

5. The manager of library (librarian) or the responsible person to whom functions of the librarian are assigned issues textbooks from library stock of the general education organization to the class teacher of pupils according to the submitted application.

6. The class teacher receives textbooks from library stock of the general education organization on all school enrollment of class and issues them to pupils according to the sheet of issue and return of textbooks.

7. Parents (legal representatives) of pupils upon termination of academic year shall provide return of textbooks in full and condition, suitable for further use, in library of the general education organization.

8. In case of transition of the pupil within academic year in other general education organization after introduction of the rent textbooks return to library stock of the general education organization. At the same time the administration of the general education organization to the pupil issues the certificate of the brought rent for use of textbooks in the current year. Based on the reference the pupil receives textbooks in other general education organization without introduction of the rent. In case of transition of the pupil within academic year in the general education organization of other country the textbooks issued in lease return to library stock of the general education organization, and the brought rent does not return.

3. Collection of the rent

9. The rent sum for each textbook is annually determined by the Ministry according to technique of forming of the amount of the rent approved by the Ministry in coordination with antimonopoly authority.

10. The term of introduction of the rent is annually established by the Ministry.

11. The organization at the beginning of academic year determines procedure for acceptance of the rent and brings the relevant information to the attention of parents (legal representatives) of pupils.

12. The rent is brought by parents (legal representatives) of pupils or sponsors (physical persons or legal entity) on settlement accounts of Organization in the servicing banks no later than the term established by the Ministry.

13. The copy of receipts of payment for use of textbooks or the notification confirming the payment implementation fact in case of payment by remote methods is provided to the class teacher of the pupil.

14. The class teacher exercises control of introduction of the rent by pupils, filling of the corresponding forms of accounting and provision to their manager of library (librarian) or the responsible person to whom functions of the librarian are assigned.

15. In case of loss or reduction in worthlessness of the textbook parents (legal representatives) of pupils indemnify loss by provision of the new identical textbook or payment of its cost by means of introduction of money on settlement accounts of Organization in the servicing banks.

16. The money which arrived from the rent is placed Organization on term deposits in the drying banks for the term of no more than 5 years and is used only on updating of textbooks of library stock of the general education organizations.

17. The textbooks published at the expense of means of the rent for use of textbooks are property of the Ministry.

4. Address ensuring separate categories of pupils of the general education organizations with textbooks

18. The certain pupil of the general education organizations from the families needing social support, textbooks are provided free of charge or on favorable terms.

19. Pupils enter category of the pupils having the right to free receipt of textbooks:

- from large families (five and more children);

- from the needy families receiving social benefits;

- from families where one or both parents are disabled people of I or II groups;

- from single-parent families;

- from families of the military personnel, the law enforcement officers who died or who became disabled people in case of execution of military or office duty;

- orphan children, children without parental support;

- children with limited opportunities of health.

20. Pupils from families with 3-4 children studying in the general education organizations enter category of the pupils having the right to textbooks with payment of 50 percent of the amount of the rent.

21. The list of the pupils receiving textbooks free of charge or on favorable terms is created by the decision of faculty meeting and affirms the order of the head of the general education organization.

22. The general education organizations annually, till September 15 of the current year, constitute lists of pupils to which:

- textbooks are provided in lease;

- textbooks are provided free of charge or on favorable terms.

5. Accounting and the reporting of issue of textbooks in lease

23. The head of district (city) department (management) of education, the head of the general education organization bear responsibility for the organization and effective functioning of system of lease of textbooks.

24. Accounting of the textbooks issued in lease is conducted in electronic form, and also in the magazine of issue and return of textbooks (numbered, strung together and certified by the head of the general education organization), the manager of library (librarian) or the responsible person to whom functions of the librarian are assigned.

25. The textbooks acquired by the general education organization by extrabudgetary funds are considered in library stock of the general education organization by the separate column with indication of source. Registration in accounting registers of new textbooks is performed in three-day time from the moment of receipt of textbooks.
