About modification and amendments in some decisions of the Government of the Republic of Uzbekistan (The presidential decree of the Republic of Uzbekistan of January 17, 2017 No. UP-4933 "About Measures for Further Simplification of Procedures and Acceleration of Realization of Objects of State-owned Property for Use in the Entrepreneurial Purposes" and the Resolution of the President of the Republic of Uzbekistan of June 16, 2017 No. PP-3067 "About measures for further enhancement of procedures of realization of objects of state-owned property")

In pursuance of the Presidential decree of the Republic of Uzbekistan of January 17, 2017 No. UP-4933 "About Measures for Further Simplification of Procedures and Acceleration of Realization of Objects of State-owned Property for Use in the Entrepreneurial Purposes" and resolutions of the President of the Republic of Uzbekistan of June 16, 2017 No. PP-3067 "About measures for further enhancement of procedures of realization of objects of state-owned property" the Cabinet of Ministers decides:

1. Make changes and additions to some decisions of the Government of the Republic of Uzbekistan according to appendix.

2. Paragraphs of the seventy eighth and the seventy ninth the subitem "e" of Item 1 appendices to this resolution become effective after three months from the date of entry into force of this resolution.

3. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan D. A. Kuchkarov and the chairman of the State committee of the Republic of Uzbekistan on assistance to the privatized companies and development of the competition of R. A. Gulyamov.

Appendix

to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of October 16, 2017 No. 837

Changes and additions made to some decisions of the Government of the Republic of Uzbekistan

1. In the resolution of the Cabinet of Ministers of October 6, 2014 No. 279 "About approval of regulations on procedure for privatization of objects of state-owned property" (the joint venture of the Republic of Uzbekistan, 2014, No. 10, the Art. 104):

a) in the paragraph the second Item 1 of the text in Uzbek to replace the word "aylantirish" with the word "ўзгартириш";

b) in the name of the text in Uzbek to replace the word "aylantirish" with the word "ўзгартириш";

in Item 2 of the word "decisions of the President of the Republic of Uzbekistan or the Cabinet of Ministers of the Republic of Uzbekistan" shall be replaced with words "in accordance with the established procedure, decisions of the President of the Republic of Uzbekistan, the Cabinet of Ministers of the Republic of Uzbekistan or the Chairman of the board of Ministers of the Republic of Karakalpakstan, hokim of areas and Tashkent";

in Item 3 of the word "decisions of the President of the Republic of Uzbekistan or the Cabinet of Ministers of the Republic of Uzbekistan" shall be replaced with words "the decisions of the President of the Republic of Uzbekistan, the Cabinet of Ministers of the Republic of Uzbekistan or the Chairman of the board of Ministers of the Republic of Karakalpakstan, hokim of areas and Tashkent accepted within the competence";

in Item 12:

In case of receipt of the request (offer) for transformation of the state organization to territorial authority, in the absence of the reasons for refusal in transformation, within fifteen working days from the moment of receipt of the request (offer) the territorial authority sends to the territorial tender committee headed respectively by the Chairman of the board of Ministers of the Republic of Karakalpakstan, hokimama of areas and Tashkent and including heads of territorial authorities of Goskomkonkurention (as the vice-chairman of tender committee), the Ministries of Finance, the Ministries of Economics, the State Tax Committee, Goskomzemgeodezkadastr, Goskomecology, Gosarkhitektstroy, Chamber of Commerce and Industry, the Center of the state sanitary and epidemiological surveillance of the Ministry of Health of the Republic of Uzbekistan (further - territorial tender committee), the relevant information with appendix of the following documents";

add with paragraphs the eighth and ninth the following content:

"The territorial tender committee considers the request (offer) for transformation of the state organization for its compliance to the approved criteria for decision making about privatization by the Chairman of the board of Ministers of the Republic of Karakalpakstan, hokimama of areas and Tashkent.

In case of need decision makings by the President of the Republic of Uzbekistan or the Cabinet of Ministers of the Republic of Uzbekistan for transformation of the state organization, the territorial authority based on the solution of territorial tender committee directs the relevant information according to the request (offer) with application of documents in Goskomkonkurention";

to consider the paragraph of the eighth the paragraph the tenth;

state Item 13 in the following edition:

"13. In case of receipt of the request (offer) for transformation of the state organization in Goskomkonkurention, in the absence of the reasons for refusal in transformation, the request (offer) goes to territorial authority for forming of the documents specified in Item 10 of this provision which are created and represented by territorial authority within fifteen working days to territorial tender committee";

state Item 15 in the following edition:

"15. Based on the arrived requests (offers) for transformation of the state organizations territorial tender committees and Goskomkonkurention in process of receipt of requests, but at least once a year together with the interested ministries and departments in accordance with the established procedure make in the Cabinet of Ministers of the Republic of Uzbekistan offers on the state organizations which are subject to privatization according to the decision of the President of the Republic of Uzbekistan or the Cabinet of Ministers of the Republic of Uzbekistan.

Offers on the state organizations which are subject to privatization according to the decision of Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent are prepared by territorial tender committee and submitted respectively for approval in Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent.

The list of the state organizations included in the privatization program can be created by the territories or industries.
